Pragmatus Telecom LLC 控告趨勢科技與 Netgear 侵犯其專利

2012 年 12 月 6 日，設立於美國維吉尼亞州的專利授權公司 Pragmatus Telecom LLC ，向美國加州北區聯邦地院提起兩起專利侵權告訴，分別控告網路安全廠商趨勢科技 (Trend Micro Incorporated) 以及網路通訊設備商 Netgear Inc.，其所提供的在線即時客服 (Live Chat Service)，侵犯 Pragmatus Telecom LLC 所擁有、透過網際網路提供遠端客戶協助 之方法與系統專利 。

Pragmatus Telecom LLC 基於本案相同系爭專利，已在 2012 年 11 月 21 日與 12 月 5 日，向德拉瓦州聯邦地院提起多起告訴，控告超過 40 家橫跨不同業別之公司的在線即時客服，包括 3M Company、Nike Inc.、AT&T Inc.、AOL Inc. 等，侵犯其專利權利。而後 Pragmatus Telecom LLC 在 2012 年 12 月 11 日與 12 日，又基於相同專利，分別向德拉瓦州與加州中區聯邦地院提起 4 起與 6 起專利侵權告訴，控告 Newegg Inc.、Foot Locker Inc.、Genuine Parts Company 等公司侵犯其專利權利。

這些案件之訴狀內容幾乎完全一樣，可以說僅是被告公司名稱的替換而已；在訴狀中 Pragmatus Telecom LLC 均指出，被告所提供的在線即時客服，至少侵犯系爭專利 US 6,311,231(‘231 專利) 之請求項 1、US 6,668,286(‘286 專利) 之請求項 9 以及 US 7,159,043(‘043 專利) 之請求項 1 。

本案系爭專利內容如下 ：

‘231 專利之名稱為 「透過使用 VoIP 之客戶聯絡通道轉換系統來協調資料與語音通訊的方法與系統（Method and system for coordinating data and voice communications via customer contract channel changing system using voice over IP） 」，於 2001 年 10 月 30 日核發；

‘ 286 專利 之名稱為「透過使用 IP 之客戶聯絡通道轉換系統來協調資料與語音通訊的方法與系統（Method and system for coordinating data and voice communications via customer contact channel changing system over IP）」，於 2003 年 12 月 23 日核發；

‘043 專利之名稱為「透過聯絡通道轉換系統來協調資料與語音通訊的方法與系統（Method and system for coordinating data and voice communications via contact channel changing system）」，於 2007 年 1 月 2 日核發。

根據其網站資料，Pragmatus Telecom LLC 的經營團隊包括 William (Bill) Marino 與 Anthony Grillo 等兩人，兩人先前曾分別擔任另一家專利授權公司 Saxon Innovations, LLC 的執行長與資深副總裁。 (973 字；表 3)
