2012 年 11 月 29 日，一家依據美國德拉瓦州法律設立之有限責任公司 CreateAds LLC (下稱 CreateAds)，向德拉瓦州聯邦地院提起 11 起專利侵權告訴，控告Google Inc.、Yahoo! Inc.、1&1 Internet Inc.、Hewlett-Packard Company、Squarespace Inc.、Intuit Inc.等多家公司，其所提供讓使用者選擇特定網頁版型來設立個人網頁之服務、或所販售讓使用者依據特定版型進行圖像設計之軟體產品 (template-based visual design generation products and services)，侵犯 CreateAds 所擁有、自動產生視覺設計之方法專利權利。
本案系爭專利為美國專利編號 US 5,535,320，名稱為 「產生視覺設計之方法(Method of generating a visual design) 」，於 1996 年 7 月 9 日核發，發明人為 Clive H. Gay 與 Henri W. Frencken 。
根據 CreateAds 對 Google 提告之訴狀，Clive H. Gay 基於其所發明之專利技術，創設兩家公司 CreateAds.com 與 Simply D'nA，在全盛期有包括 8 名軟體工程師在內超過 80 名的員工，而系爭專利技術則被推廣應用於商業行銷、客製化使用者介面與廣告設計等領域中。(521 字；表 3)
