2012年11月13日，美國德拉瓦州以網路多媒體傳輸技術為核心的專利授權公司Afluo, LLC (下稱Afluo)，向德拉瓦州聯邦地院提告，控告軟體公司Adobe Systems Inc.所開發販售之Adobe Flash Media Server相關產品、以及網路軟體與技術服務公司Akamai Technologies, Inc.與Level 3 Communications, Inc.所開發販售之支援Adobe Flash Media Server的網路多媒體串流軟體產品或技術服務，侵犯Afluo所擁有多媒體資料串流技術之專利權利。
本案系爭專利為美國專利編號US 5,995,091，名稱為「串流多媒體資料之系統與方法(System and method for streaming multimedia data)」，於1999年11月30日核發，發明人為Scott Near與Safa Alai，原始權利人則為Learn2.com, Inc.公司(其原為Learn2 Corporation公司下從事線上數位學習相關業務之子公司，Learn2 Corporation於2002年出售該業務相關資產給Learn.Com, Inc.，而後Learn.Com, Inc在2010年被Taleo Corporation併購，而Taleo Corporation又在2012年被Oracle Corporation併購)。
根據Afluo網站所載資訊，其所擁有之主要專利權利共有4項，除本案系爭專利外，還包括US 5,963,217、US 6,433,784與US 6,636,219等，都是動畫視訊傳輸相關技術，而後兩項專利之原始權利人分別是Learn2 Corporation與Learn.Com, Inc.，可推知相關專利權利，應是在相關公司併購的過程中被釋出流到Afluo手中。Afluo網站資訊指出，目前已將專利技術授權給IBM、Microsoft、AOL等公司。(691字；表2)
