2012年11月9日，一個先前居住在伊利諾州的個人發明人Steven E. Berkheimer，向美國伊利諾州北區聯邦地院提起專利侵權告訴，控告惠普科技公司(Hewlett-Packard Company，HP)所行銷販售之文件自動化管理軟體產品HP Exstream，侵犯其所發明並擁有之文件或圖像檔案項目進行歸檔(archiving)的方法與系統專利權利。
本案系爭專利為美國專利編號US 7,447,713，名稱為「歸檔與輸出文件或圖像項目之系統與方法(System and method for archiving and outputting documents or graphical items )」，於2008年11月4日核發，發明人為本案原告Steven E. Berkheimer。
HP在2008年併購了軟體公司Exstream Software, LLC，該公司主要供應用於簡化並傳輸個人化文件與通訊資料的企業用軟體，在併購後該公司被納入HP影像列印事業群（the Imaging and Printing Group, IPG）中的網頁服務與軟體事業單位(the Web Services and Software business unit)中。HP Exstream軟體主要協助企業可以更有效率地與其個別客戶間進行通訊並整理歸檔相關客戶資料與文件，而這樣的服務功能，被原告認為是對系爭專利權利構成直接與間接侵權。(462字；表2)
