Philips控告Aurora Lighting侵犯其7項LED相關專利

2012年11月2日,荷商Koninklijke Philips Electronics N.V.以及其旗下負責LED照明業務之Philips Solid-State Lighting Solutions, Inc.(以下合稱Philips),向美國麻薩諸塞州聯邦地院提起告訴,控告照明設備集團the Aurora Group之美國代表公司Aurora Lighting, Inc.(下稱Aurora Lighting)、以AURORAR、LUNAR與SOLAR等品牌所販售之LED照明設備產品,包括各款LED燈泡產品,侵犯Philips所擁有(部分是從其所收購之Color Kinetics, Inc.公司所取得)、7項與LED照明有關的專利權利。

本案系爭專利如下:

  • 美國專利編號US 6,250,774,名稱為「照明器具(Luminaire)」,於2001年6月26日核發,發明人是Simon H. A. Begemann與Albertus J. H. M. Kock,權利人是U.S. Philips Corp.;
  • 美國專利編號US 6,561,690,名稱為「以LED發光光源為基礎的照明器具(Luminaire based on the light emission of light-emitting diodes)」,於2003年5月13日核發,發明人是Christophe Balestriero與Marc Olivier Flaissier,權利人是Koninklijke Philips Electronics N.V.;
  • 美國專利編號US 6,788,011,名稱為「多重色彩LED照明方法與裝置(Multicolored LED lighting method and apparatus)」,於2004年9月7日核發,發明人是George G. Mueller與Ihor A. Lys,原始權利人是已被Philips併購之Color Kinetics, Inc.;
  • 美國專利編號US 7,038,399,名稱為「為照明裝置提供電源之方法與裝置(Methods and apparatus for providing power to lighting devices)」,於2006年5月2日核發,發明人是Ihor A. Lys等三人,原始權利人是Color Kinetics, Inc.;
  • 美國專利編號US 7,161,311,名稱為「多重色彩LED照明方法與裝置(Multicolored LED lighting method and apparatus)」,於2007年1月9日核發,發明人是George G. Mueller與Ihor A. Lys,原始權利人是Color Kinetics, Inc.;
  • 美國專利編號US 7,262,559,名稱為「LED驅動器(LEDS driver)」,於2007年8月28日核發,發明人是Ajay Tripathi等4人,權利人是Koninklijke Philips Electronics N.V.;
  • 美國專利編號US 7,659,673,名稱為「提供可控變換電源至電源負載之方法與裝置(Methods and apparatus for providing a controllably variable power to a load)」,於2010年2月9日核發,發明人是Ihor A. Lys,權利人是Philips Solid-State Lighting Solutions, Inc.。

Philips於2012年3月26日亦曾項本案同樣法院提告,控告另一家LED照明設備商Nexxus Lighting, Inc.,侵犯其所擁有之6項LED相關專利(案號為1:12-cv-10549-JLT),其中兩項專利(US 6,250,774與US 7,038,399)與本案重疊。(897字;表2)
