VideoShare控告YouTube侵犯其串流視訊檔案分享方法專利

2012年10月26日，一家營業處所設立於美國麻薩諸塞州之公司VideoShare, LLC，向麻薩諸塞州聯邦地院提告，控告視訊分享網站YouTube, LLC所提供之串流視訊檔案分享服務與產品，侵犯VideoShare所擁有、分享串流視訊檔案之方法專利權利。

本案系爭專利為美國專利編號US 7,987,492，名稱為「分享一項串流視訊 (Sharing a streaming video)」，於2011年7月26日核發，發明人為Gad Liwerant、ChristopherDodge以及Guillaume Boissiere。系爭專利包括兩項獨立請求項(請求項1與12)，分別為讓一網路上複數電腦可以分享串流視訊之方法與系統。

在網路上不易搜尋到有關原告VideoShare的資訊，但其在2012年7月19日，亦曾向本案相同法院提告，控告另一影音分享網站Brightcove Inc.侵犯本案系爭專利權利(案號為1:12-cv-11213-MLW)。對比兩案訴狀內容是幾乎一樣，只有被告名稱與相關資訊有所更換，不僅篇幅均只有4頁，連控告侵權行為之文字描述亦是完全相同。在智財權相關網路雜誌IPWatchdogR上便有文章指摘，這樣指控內容交代不清的訴狀應被法院駁回，以避免專利訴訟機制被不良行為者所濫用(Gene Quinn，YouTube Sued for Patent Infringement，http://www.ipwatchdog.com/2012/10/31/youtube-sued-for-patent-infringement/id=29550/)。(592字；表2)
