2012 年 10 月 18 日，設立於美國德拉瓦州的 e.Digital corporation. ( 以下簡稱 e.Digital) 以專利侵權為由，分別控告設立於韓國的 Diasonic Technology Co., LTD( 以下簡稱 Diasonic) 與設立於 佛羅里達 州的 Sec Tech, LLC ( 以下簡稱 Sec Tech) 等所製造、使用、提供銷售、或在美國販賣、進口銷售、進行的產品侵權，全案將由美國伊利諾州北區法院負責審理調查。
本案的系爭專利有四件，編號為： US 5,742,737 、 US 5,491,774 、 US 5,839,108 、 US 5,842,170 使用快閃記憶體手持式裝置錄音播放相關的專利，爭議產品如表一所示。
- US 5,491,774 ： ”Method for recording voice messages on flash memory in a hand held recorder” ，於 1994 年 04 月 09 日申請，於 1996 年 02 月 13 日獲准，專利權人在 2012 年 9 月 18 日變更為原告 e.Digital 。 774 系爭專利之申請專利範圍其請求項共 21 項，獨立項有 2 項。
- US 5,742,737 ： ”Method for recording voice messages on flash memory in a hand held recorder” ，於 1997 年 03 月 03 日申請，於 1998 年 04 月 21 日獲准，為 US5,491,744 專利的延伸部分，專利權人在 2012 年 9 月 18 日變更為原告 e.Digital 。 737 系爭專利之申請專利範圍其請求項共 12 項，獨立項有 5 項。
- US 5,839,108 ： ”Flash memory file system in a handheld record and playback device” ，於 1997 年 06 月 30 日申請，於 1998 年 11 月 17 日獲准，專利權人在 2012 年 9 月 18 日變更為原告 e.Digital 。 108 系爭專利之申請專利範圍其請求項共 6 項，獨立項有 3 項。
- US 5,842,170 ： ”Method for editing in hand held recorder” ，於 1996 年 12 月 23 日申請，於 1998 年 11 月 24 日獲准，專利權人在 2012 年 9 月 18 日變更為原告 e.Digital 。 170 系爭專利之申請專利範圍其請求項共 13 項，獨立項有 2 項。

e.Digital 在 1988 年 2 月 11 日成立於加拿大名為 340520 B.C. Ltd. ，在該年 4 月 7 日更為 Norris Communication Corp. ， 1996 年在德拉瓦州註冊，並於 1999 年 1 月經股東批准名稱變更為 e.Digital ，該公司在 1994-1996 年間推出以快閃記憶體為儲存的隨身錄音裝置，但是並未在市場獲得成功。可是該公司擁有 快閃記憶體手持式裝置錄音播放專利包，將會對於使用快閃記憶體進行音訊儲存與播放之公司造成阻斷之效應。 (803 字；表 2)
