手機保護殼訴訟 Speculative Product Design 在 ITC 控訴阿里巴巴等中國公司

Speculative Product Design, LLC ( 下稱 SPECK 公司，其以 Speck of Mountain View 為名從事商業活動 ) ，在 2012 年 9 月 26 日向美國美國國際貿易委員會 (ITC) 提出訴狀，請求 ITC 依據關稅法 337 條進行調查。

該訴狀中指稱，以下所列出的公司 ( 下稱對造 ) ，非法地向美國本土進口、販賣或為進口而販賣侵害其編號 US 8,204,561 專利權 ( 下稱 '561 專利 ) 的手持式行動電子裝置：

中國 Anbess 電子有限公司；
中國阿里巴巴有限公司；
美國加利福尼亞州聖克拉拉市阿里巴巴公司；
美國加利福尼亞州聖克拉拉市全球速賣通有限公司；
美國加利福尼亞州聖克拉拉市的必應貿易有限公司；
加利福尼亞州雷東多海灘 BodyGlove 國際有限責任公司；
伊利諾伊州費洛斯公司；
中國捷盛科技；
JWIN 電子公司，其以紐約華盛頓港的 iLuv 公司為名從事商業活動；
Project Horizon 公司，其以佛羅里達州傑克遜維爾市的 INMOTION 娛樂為名從事商業活動；
中國 ROCON 數碼科技公司；
中國深圳市華豐科技有限公司；
Superior Communications 公司，其以加利福尼亞州的 PureGear 公司為名從事商業活動；
香港 SW-Box.com ，也叫做 Cellphonezone 有限公司；

SPECK 公司所提出的 '561 專利，主要界定一體成型式的手機保護殼結構。這篇專利申請日期是 2011 年 10 月 26 日，而獲准公告日期是 2012 年 6 月 19 日。系爭專利US 8,204,561 claim 1解析，如下：

US 8,204,561 claim 1:

1。A one-piece case for enclosing a personal electronic device comprising:

a flexible inner layer co-molded with an exterior hard layer and permanently affixed together to form a co-molded one-piece assembly.彈性內層和堅硬外層共模，永久結合在一起成共模一體結構

wherein the co-molded one-piece assembly is sufficiently flexible to accept insertion of the personal electronic device and sufficiently rigid to securely retain the inserted personal electronic device, 共模一體結構柔軟的足以收納手機，堅硬的足以固定收納的手機

堅硬外層具有一堅硬外層底面，複數堅硬外層側面，一堅硬外層切口. 堅硬外層底面和堅硬外層側面大小和形狀實質上包覆彈性內層底面和彈性內層側面，該堅硬外層切口永久地被部分彈性內層所填充。

在向 ITC 提出訴狀的前一天，即 2012 年 9 月 25 日， SPECK 公司亦就 '561 專利，向美國加州法院 (U.S. District Court for the Northern District of California ) ，對 Superior Communications 公司、 BodyGlove 國際公司及 JWIN 電子公司等提出專利侵權訴訟。

在訴狀中， SPECK 公司向 ITC 請求發予全面性禁制令（ general exclusion order ），亦或有限性禁制令 ( limited exclusion order) 以禁止侵權產品輸入美國本土，並要求 ITC 向對造發出永久停止侵害命令 (permanent cease and desist order) ，以命令對造停止其侵害行為，避免專利權持續受到侵害。

目前，這件案子已進入 ITC 審理程序， ITC 將在數月之內著手進行調查。 (759 字；表 1)

2012 年12月26日SPECK公司再向美國美國國際貿易委員會 (ITC)提出訴狀，以相同專利US 8,204,561指控台灣及中國廠商侵權。

06-20規模小廠直接以"缺席"放棄美國市場

原告： Speculative Product Design

Speculative Product Design在美國ITC啟動337調查案[337-TA-861 & 337-TA-867]，2013年6月陸續發現有些規模小廠直接以拒收訴狀而被判"缺席"(Default)。

小廠無力負擔上百萬的ITC律師費，打完ITC訴訟肯定也是倒閉，不如現在就倒閉，保留現金。另外開一家新公司，重起爐灶，新公司相同產品不要進美國，或改賣其他無侵害的新產品。

07-01SPEC勝訴 ITC同意核發禁制令

2014 年6月20日手機保護殼訴訟SPECK公司勝訴[337-TA-867 & 337-TA-861]，ITC終判同意核發一般性禁止進口令(general exclusion order)。

本案緣起於2012 年 9 月 26 日Spec- ulative Product Design 在 ITC 控訴阿里巴巴等中國公司進口至美國境內的手機保護殼產品侵權。

從ITC發出禁制令(Issurance of general exclusion order)通知書得知，除了Body Glove公司被認定無侵害情事外, 其他廠商都以(1)和解或是(2)雙方合意撤訴，或是(3)缺席判決敗訴侵權產品被擋關而無法進口美國。
