2012 年 10 月 22 日，總部設於加州聖地牙哥的無線寬頻接取解決方案供應商 Novatel Wireless, Inc. 以及其完全控股子公司 Novatel Wireless Solutions, Inc.( 以下合稱 Novatel Wireless) ，向加州南區聯邦地院提告，控告中國通訊設備供應商中興通訊 (ZTE Corp.) 及其美國分公司 ZTE (USA), Inc.( 以下合稱 ZTE) ，其輸入至美國境內與販售之行動熱點裝置與無線數據機等產品，包括由行動通訊業者 Verizon Wireless 以其品牌名 Verizon Jetpack 890L 行銷的行動熱點裝置產品，侵犯 Novatel Wireless 所擁有、與可讓複數行動通訊裝置，同時連接網際網路之無線閘道裝置有關的 專利權利。
本案系爭專利為美國專利編號 US 8,208,517 ，名稱為 「複數通訊模式之無線數據機的配置系統與方法 ( Systems and methods for a multi-mode wireless modem ) 」，於 2012 年 6 月 26 日核發。系爭專利為 Novatel Wireless 知名之 MiFi R 智慧行動熱點 (MiFi R Intelligent Mobile Data Hotspot) 產品之相關技術，該產品為 Novatel Wireless 於 2009 年 5 月所推出的產品，目前全球有超過 25 家電信公司採用了這套設備。
早在 2010 年 12 月 9 日， Novatel Wireless 便曾向加州南區聯邦地院提告 （案號為 3:10-cv-02530-LAB-JMA ） ，控告其競爭對手 Franklin Wireless Corp. 以及 ZTE 侵犯其 5 項專利權利 （ US 5,129,098 、 US 7,318,225 、 US 7,574,737 、 US 7,319,715 以及 US 6,785,556 ） ，而該 5 項專利亦是與 MiFi R 產品有關的專利技術。該案目前仍在審理中。
有趣的是， Novatel Wireless 在其訴狀中特別指出一件與本案無關之事實，即 ZTE 美國分公司目前正受到美國商業部 (United States Department of Commerce, DOC) 與 FBI 等單位進行是否涉嫌違法輸出貨品至伊朗所進行之犯罪調查，似乎有意突顯 ZTE 的違法形象。 (743 字；表 2)
