2012 年10月12日，Telinit Technologies, LLC公司 (Telinit) 向美國東德州地方法院(U.S. Texas Eastern District Court)提起專利侵權訴訟案(案號為2:2012cv00662，下稱Telinit訴訟案 )，控告微軟公司(Microsoft Corporation)、Skype Communications S.a.r.l.以及 Skype Inc.(下稱Skype)侵害其專利。
本訴訟案的原告Telinit公司是一間美國德州註冊公司。而這樁訴訟案之中的被告，有微軟公司(Microsoft)及Skype公司。Skype總部設於盧森堡，於2011年10月Microsoft併購Skype。
被告以被訴侵害事實有一部分發生在德州為由而以美國東德州地方法院為本案件的法律管轄地。並以被告三方面對著共通的事實問題，例如「其使用者初始化網路電話產品在其特徵上是否符合系爭案專利範圍中所主張的特徵?」以及「需要向原告補償多少的合理權利金才適當?」等等，確立被告三方為共同被告(Joined defendants)。
Skype公司，提供了廣為人知的Skype 5.10、Skype Manager及Skype Connect等等網路電話服務。而在2011年微軟公司收購Skype並成為微軟公司內部的一個新事業部”。之後，微軟公司在其產品服務中強化了網路電話通訊的部分，允許其產品Lync、 Lync Online 及/或Office 365的使用者經由該些產品的界面而與其他的微軟使用者及第三方進行通話。
原告Telinit公司在訴狀中稱，Skype所提供的網路電話服務，以及微軟公司所提供的網路電話通訊服務部分，使用了原告所持有專利關於網路電話系統使用者初始化方面的技術，例如，提供使用者切換撥打PSTN（公眾電話網路，即一般市話及行動電話）的功能、電話簿查找撥打的功能。Telinit公司並聲稱，該等被告更涉及誘使侵權(inducing infringement)及協助侵權(contributory infringement)。
本案所涉之系爭專利為：於 2001年2月20日核發之美國專利編號 US6,192,123專利，其名稱為「用於初始化運用數據網路之電話呼叫的方法及裝置（Method and apparatus for initiating telephone calls using a data network）」，發明人為David P. Grunsted, Christopher C. Krebs, Bruce A. Botkin, Daniel L. Kemp, Kevin Dohrmann等。從美國專利局的資料查詢得知，本系爭案的原專利權人為National Tech Team Inc.，中間幾經易手後，最後於2012/01/28轉讓至Stature Ventures, LLC。而本件系爭專利是該些發明人唯一申請的一件專利。
本網站查得Stature Ventures, LLC專利授權公司原隸屬於Allied Security Trust（AST聯盟：由幾家科技巨頭攜手應對專利蟑螂訴訟攻擊而組成）；但是，目前AST已將該專利及Stature Ventures, LLC公司轉賣出去，雖然未說明賣給誰，但是目前該專利由Telinit Technologies, LLC公司取得，由專利訴訟律師Beatriz Lopez主導，近來由Beatriz Lopez領軍的多家patent troll公司，已陸續向營運公司展開攻擊。(825字；表2)
