2012 年 9 月 19 日，內華達州的 Unwired Planet LLC.( 以下簡稱 Unwired Planet, http://www.unwiredplanet.com/) 以十項已核准專利 (US6317594 、 US6317831 、 US6321092 、 US6532446 、 US6647260 、 US6813491 、 US7020685 、 US7233790 、 US7299033 與 US7522927) 向雷諾分院提告，控訴 Apple Inc. ( 以下簡稱 Apple) 其提供的相關服務機制與功能侵權。

Unwired Planet 成立於 1994 年，是行動網路技術的先驅者。該公司發明許多能讓行動裝置連接至網路的相關技術，例如：無線應用協定 (Wireless Application Protocol, WAP) 。最初， Unwired Planet 關注 “ 網際網路隨身帶 ” (internet-in-your-pocket) 的概念，就如本案所述各項專利技術內容。在當時，幾乎沒有科技公司對這類的技術有興趣。但 Unwired Planet 卻一直堅持下去，將瀏覽器功能內建到電話中；一直到 1996 年，開始與 AT&T 合作開發 ( 當時簽約時的公司名稱是 Libris ，但在 1994 年改名為 Unwired Planet) 。

隨後在 1997 年， Unwired Planet 開始積極推動全球標準，與 Ericsson 、 Motorola 、 Nokia 共同在 1997 年發起 WAP 論壇，共同為無線上網制定統一的規格，也就是 WAP (Wireless Application Protocol) 。到 2001 年止，已經有超過 500 家成員參與 WAP 論壇。 Unwired Planet 也從 1999 年開始發行股票，並改名為 Phone.com ，專注於各式無線裝置提供瀏覽器軟體及工具，以便能成功連接到網路，例如： Up.Mail 、 Up.Organizer 、 Up.Web 、 Up.Browser 與 Up.Smart 、 … 等等產品。 1999 年 8 月，全球已經有 31 個網路營運商向 Unwired Planet 取得授權；也因此，美國今日 (USA Today) 稱 Phone.com 為 “ 無線網路中的關鍵 ” (the linchpin for the wireless internet) ，並說它發明的各項產品撼動當時將近 80% 可以上網的電話市場。到了 2000 年， Phone.com 併購 Software.com ，並成立 Openware Systems 。 2012 年又進行公司重整，將非核心業務轉售出去，並將部分業務轉出成立 Openwave Mobility, Inc. 公司，並且與 Unwired Planet 皆轉型為具研究型的專利授權公司 (NPE) 。

Openwave Systems 在 2011 年 8 月 30 日於美國德拉威爾地方法院及美國 ITC 分別控告 APPLE 及 RIM ，關於行動上網技術之專利侵權訴訟，並要求支付賠償金。不論是 Openwave Systems 或是改名後 Unwired Planet ，在這三次訴訟共拿出 25 項具攻擊性專利砲打國際大廠，由此可見，它的專利能量非一般。請參考本網站前期文章 【 Openwave 在美控告APPLE 及RIM 侵犯行動裝置技術 】 (1586 字；表 3)
