2012年7月18日，現任教於以色列理工學院(Rensselaer Polytechnic Institute，RPI，為美國最早的理工大學)、並被授予the Wellfleet Senior Constellation Professor, Future Chips之榮譽教授頭銜的E. Fred Schubert(下稱Schubert)，向德拉瓦州聯邦地院提起三件專利侵權告訴，分別控告美國Cree, Inc.(下稱Cree)、歐洲Philips Lumileds Lighting Company LLC(下稱Philips Lumileds)以及德國OSRAM Opto Semiconductors GmbH(下稱OSRAM)等三家世界級LED大廠，其所製造販售的高亮度氮化鎵基LED(high-brightness Gan-based LEDs)系列產品，侵犯Schubert所共同發明並擁有權利、與氮化鎵光電半導體蝕刻技術相關之方法專利。
本案系爭專利為美國專利編號US6,294,475，名稱為「第三族氮化物材料之濕式化學蝕刻方法(Crystallographic wet chemical etching of III-nitride material)」，發明人為Schubert與Dean A.Stocker，該專利於2001年9月25日核發。
Schubert長期耕耘於化合物半導體之領域，致力於研發諸如共振腔發光二極體(resonant-cavity light emitting diodes)、光子晶體發光二極體(photonic crystal light emitting diodes)、LED全方位反射器(omni-directional reflectors for LEDs)等相關技術；其列名為30項專利之發明人或共同發明人，並共同發表了超過300篇學術論文。
OSRAM、Philips Lumileds與Cree，以其相關產品之獲利來看，均可被列為2011年世界前十大LED元件供應商，OSRAM名列第三，而Philips Lumileds與Cree則並列第六。(512字；表2)
