2012年06月29日，澳洲的電腦安全防護軟體研發商Uniloc透過其在美國及盧森堡的子公司(以下簡稱Uniloc)以1項專利侵權為由，分別控告設於美國佛羅里達州的Depositphotos (以下簡稱Depositphotos)及Dreamstime (以下簡稱Dreamstime)所製造、使用、提供、販賣及/或為販賣之要約之用以授權、儲存、管理、研發、購買及/或販賣智慧財產權之方法、設備及系統侵權，全案將由美國德州東部聯邦地院泰勒分部負責審理。
根據訴狀中所述，原告Uniloc認為被告Depositphotos及被告Dreamstime以廣告、行銷、進口、使用、設置、販賣及/或販賣之要約等行為進行侵權。依據28 U.S.C. §1391(b)(c)及§1400(b) 美國德州東部聯邦地院具有管轄權。
本案系爭專利US7,099,849名稱為「整合媒體管理及權利分配設備(Integrated media management and rights distribution apparatus)」，於2001年12月28日申請，於2006年08月29日獲准，發明人為Russell P. Reeder及Ramond M. Haynes等二人，原始專利權人Rightsline, Inc.，經多次專利權移轉，於2011年3月由DEVEREAUX, MICHAEL讓與給原告Uniloc。系爭專利為2000年12月28日申請之臨時申請案60/259,194的正式申請案。系爭專利之申請專利範圍其請求項共29項，獨立項有4項(第1、7、11、25項)。
Uniloc公司1992年成立於澳洲，2003年於美國羅德島及南加州成立子公司Uniloc USA來負責專利訴訟事務。主要提供研發、開發、製造及授權資訊保全技術之解決方案、平台及規格，包括用於保全軟體應用及數位內容之解決方案。(595字)
