從過去專利訴訟的歷史案件來看，微軟(Microsoft)極少是主動提告的一方，然而在2010年5月18日微軟主動提出告訴，控告CRM軟體研發公司Salesforce.com，涉嫌侵犯微軟九項專利技術，全案目前在西雅圖聯邦法院審理。
本案的系爭專利有九項，分別為專利編號7,251,653、5,742,768、5,644,737、6,263,352、6,122,558、6,542,164、6,281,879、5,845,077和5,941,947。微軟宣稱 Salesforce.com的 CRM產品在後端和使用者的功能選單、工具欄和製圖介面功能，以及從遠端電腦獲取軟體的方法中使用了微軟的技術。
Salesforce.com成立於1999年，主要是為公司廠商做客戶關係管理的軟體設計和系統服務，搭配雲端運算技術的興起，目前在各大洲都設有據點。其創辦人Marc Benioff在10年前曾大膽預言“軟體即將滅亡”。最近又預言蘋果市值必超過微軟。salesforce.com目前擁有全球大約7.5萬家企業用戶，通由其平台在雲端管理和共享資訊。
在CRM市場微軟一直扮演要角，其主要競爭者就是Salesforce.com。訴訟的導因仍是為搶奪CRM市場以及雲端運算市場。雲端運算為政府四大智慧產業，見『雲端運算產業發展方案 (99.04.29行政院會通過)』，此案值得過內產、學、研各界進一步關注其發展。(258字；表1)
