根據以往統計,每年歲末之際也是專利侵權訴訟最活躍之時刻,果不其然,智慧型手機大廠龍頭諾基亞(Nokia Inc)與蘋果電腦(Apple Inc)專利侵權戰火,如預期地持續延燒至美國國際貿易委員會(ITC)。2009年12月29日,諾基亞公司於美國Delaware聯邦地院及美國國際貿易委員會同時提出申訴,要求美國國際貿易委員會展開ITC 337調查。
諾基亞指控被告蘋果公司其侵權產品非法進口到美國銷售/或在美國銷售某些電子設備,包括移動電話,便攜式音樂播放器,電腦等產品,宣稱侵犯了諾基亞所擁有的7件美國專利號 US6714091、US6834181、US6895256、US6518957、U6073036、U6262735和US6924789(統稱“所稱的專利”)。本次該7件系爭專利與2009年10月22日於美國Delware聯邦法院提告之10件專利,完全不相同。參考本網站相關文章:【Nokia 控告Apple iPhone侵犯其十項手機專利 】。

本案被指控侵權的蘋果產品,包括:iPhone、iPhone 3G、iPhone 3GS手機、iPod Nano,iPodTouch、iPod Classic便攜式音樂播放器, iMac、Mac Mini、iMac Pro,MacBook上的MacBook Pro和MacBook Air電腦等產品直接侵權,這些誘導侵權所稱侵犯專利,有時稱為”實施的專利(implementation patents)” 。這些“實施專利”,並非必要的與無線通信標準有關,但證實諾基亞自己的產品與那些競爭對手的區隔。據諾基亞稱專利涉及以下發明如下:
- (一)'091專利”涉及到一個可編程的電壓控制振盪器(“振盪器”)的增加效率的無線設備和使用較少的電力比傳統和VCO,從而提高電池壽命“;
- (二)'181專利”涉及結合天線與發話者的手機,以減少手機的外觀尺寸和提高其性能;
- (三)'256專利”涉及到減少整個PCB的晶片數量”,從而降低了電子裝置總體尺寸和功耗的設備;
- (四)'957專利”涉及到解除手機用話中有關觸控面板的啟動;
- (五)'036專利”涉及用戶的指尖於螢幕的“放大鏡或擴大的部分”;
- (六)'735專利”涉及“電子裝置與訊息之間連接的應用程序“;及
- (七)'789專利”涉及”按單個鍵一次輸入數據,並使用觸摸瀏覽應用。
關於行政補救措施,諾基亞要求委員會向蘋果發布永久排除令和永久停止命令定。
根據Gartner統計2009年第三季諾基亞在智慧型手機市場佔有率從2008年第三季的42.3%降至39.3%。而諾基亞於2009年1至9月底在手機部門的營運毛利只剩下11.3%。於是諾基亞期望提高手機部門毛利之下,諾基亞預計在2010年只推出10款智慧型手機,比起2009年高達20款機種的數字,減少了50%。目前諾基亞期望2010年的營運毛利能提昇至12~14%,而且期待應用程式商店Ovi能獲得更多開發者的注意,以強化應用程式的多樣性。
最近,諾基亞努力積極轉型,對於2010年其手機之想法與策略都有些調整,看來全面啟動專利訴訟抵禦蘋果,悍衛其智慧型手機市場也是其策略運用之一。蘋果的態度及策略又如何?如何應對及反擊?看來又是一場精采可期的訴訟之爭。(888字;表2)
