寬頻訊號傳輸專利訴訟 ChanBond控告Bright House Networks

2015年09月21日,註冊於美國德拉瓦州的專利授權公司ChanBond, LLC向美國德拉瓦地方法院(U.S. District Court For the District of Delaware)起訴全美第六大的有線網路設備商Bright House Networks, LLC侵犯其US7,941,822號、US8,341,679號、US8,984,565號(以下分別稱 ‘822號、’679號、’565號)寬頻訊號傳輸專利的專利權。

 ‘822號專利、679號專利、’565號專利屬於同一專利家族,名稱均為「用以於一寬頻訊號散佈系統上散佈數位訊號的智慧系統與其方法(Intelligent device system and method for distribution of digital signals on a wideband signal distribution system)」。

‘822號專利為該專利家族之母案,申請日2008年02月01日,獲證日2011年05月10日。其技術特徵略為:接收一個包含多通道的調變RF訊號(modulated RF signal containing multiple channels)及一個通道使用中資訊(channel in use information),其中,該通道使用中資訊係用以辨識該數位調變RF訊號中的各個通道,且該調變RF通道包含定址於至少一個可定址裝置的資訊(information addressed to at least one addressable device)。當該通道使用中資訊辨識出至少兩個通道,作為調變RF訊號的內容資訊,以定址出該至少一個可定址的裝置時,解調變包含於該調變RF訊號中的至少兩個通道,並結合至少兩個被該解調變單元解調變的通道而成一個數位訊號串流,再輸出該數位訊號串流至至少一個可定址的裝置。

‘679號專利為‘822號專利的分割申請案,申請日2009年09月22日,獲證日2012年12月25日。其技術特徵略為:接收一RF通道使用中資訊(RF channel in use information)及一流量資訊(traffic information);根據該RF通道使用中資訊,識別出當下沒有被該寬頻訊號分佈系統使用的RF通道,判斷哪些動態定址RF通道(dynamically allocated RF channels)可用以攜帶該數位資訊;再根據該數位資訊的資訊吞吐量(information throughput of the digital information)及該單一RF通道的資訊容量(information capacity of a single RF channel),判斷該動態定址RF通道的數量;而當該數位資訊的資訊通吐量到達一個單一RF通到的資訊容量時,指示該調變單元分散該接收的數位資訊至最少兩個動態定址RF通道,並指示於該些RF通道中的特定動態定址RF通道之上,攜帶該調變RF訊號中的數位訊號。

 

‘565號專利為‘679號專利的分割申請案,申請日2012年11月20日,獲證日2015年03月17日。其技術特徵略為:接收一含有數位資訊的數位串流(digital stream),一通道使用中資訊(channel in use information),一個用以識別數位資訊吞吐量(information throughput)的流量資訊(traffic information); 根據該數位資訊的資訊通吐量及該單一RF通到的資訊容量,判斷可用以攜帶數位資訊的動態定址RF通道的數量;當該數位資訊的資訊吞吐量到達一個單一RF通到的通道容量時,指示調變單元利用至少兩個動態定址RF通道,攜帶該調變RF訊號中的數位訊號,以發送至該寬頻訊號分佈系統。

原告ChanBond為一專利授權公司,於2012年12月接受移轉自CBV. Inc的本案三件爭議專利,並於2015年09月開始對多家網路通訊公司發動專利訴訟。

被告Bright House Networks成立於1994年,為美國第6大的有線網路提供業者。其服務項目涵蓋數位電纜、家用電信服務、商務電信服務、高速網路建構、及各種資料安全解決方案。

原告於起訴狀陳稱,簡言之本案專利家族之技術係關於「增進寬頻分散系統中的資料傳輸(improving the data transmission of wideband distribution systems)」。並被納入「纜線數據服務介面規格3.0版以上(Data Over Cable System Interface Specification (“DOCSIS”) standard, version 3.0)」之中。現由於被告製造、銷售的有線系統及服務(cable systems and cable services),係採用該DOCSIS V.3.0之規範,侵犯了本案專利家族所保護的技術,故請求法院確認被告侵權、要求被告停止侵害,並賠償原告之損失。(1422字;表7)
