2015年6月19日，營業處所設於美國德州的專利授權公司Cypaleo LLC (下稱Cypaleo)，向美國德州東區聯邦地院提起8起專利侵權告訴，控告多家公司所製造販賣之互動通訊裝置(interactive communication devices)產品，例如智慧型手機、平板電腦等產品，侵害Cypaleo所擁有之系爭專利權利。
在Cypaleo所起訴的8起專利侵權告訴中，被控侵權的8家公司包括3家台灣業者：宏達電(HTC Corporation，其美國分公司HTC America, Inc.亦被列為被告)、宏碁(Acer, Inc.，其美國分公司Acer America Corporation亦被列為被告)以及華碩(被列為被告者為其美國分公司ASUS Computer International，下稱ASUS)。另外5家公司則為法國消費電子產品製造商Archos S.A.、美國電腦硬體設備廠Dell Inc.、美國手機品牌廠BlackBerry Corporation與Blu Products, Inc.、大陸手機品牌廠酷派之美國分公司Coolpad Technologies, Inc.等。
本案系爭專利為美國專利編號US 5,638,427，名稱為「操作者控制之互動通訊裝置(Operator-controlled interactive communication device)」，於1997年6月10日核發，原始權利人為Xerox Corporation (下稱Xerox)。系爭專利之申請日為1994年7月1日，是故其權利期間已經屆滿，也因此Cypaleo在其訴狀中僅請求法院判給專利侵權之損害賠償，因為其已無行使侵權行為除去請求權之請求權基礎。
根據本案系爭專利說明書中發明內容(summary of the invention)部分所述，系爭專利發明為可用於不具備互動通訊功能之影印機或印表機的操作者控制互動通訊裝置(an operator controlled interactive communication device for copy machines and printers having no interactive capabilities)，其可連接電話線或其他通訊線路，讓技術人員可以與外部場所進行通訊；另一方面，系爭專利發明所描述之裝置亦可以提供連接遠端互動通訊系統之電話線路給具備互動通訊功能的機械使用(a phone line connection for a remote interface communication system is provided for machines having such capabilities)。簡而言之，系爭專利發明之原始目的是用來讓影印機或印表機等設備，可以透過不同連接線路進行互動通訊。
以Cypaleo控告ASUS侵權的案件為例，Cypaleo在其訴狀中主張，ASUS所製造販賣的ASUS PadFone 2與ASUS PadFone X等產品，其具備顯示器(display)、輸入裝置(input device)、通訊傳送介面(communication transmission interface)、電話機連接器(telephone handset connector)、電腦連接器(computer connector)以及遠端互動通訊連接器(remote interactive communication connector)等，而輸入裝置與遠端互動通訊連接器讓被控侵權產品這樣的互動通訊裝置，可以與具備以及不具備遠端互動通訊系統之機械搭配使用，例如智慧型手機印表機(smartphone printer)等，如此便至少侵害了系爭專利之請求項1。
根據德州公司登記資料，本案原告Cypaleo登記設立日期為2015年3月23日。而根據美國專利商標局(USPTO)的專利轉讓資料，原始權利人Xerox將系爭專利權利移轉給Cypaleo的生效日期為2015年3月30日。前述專利權利轉讓發生在專利權利期間屆滿之後，可推知專利轉讓之目的並不是商業化或者資產運用，而是透過興訟來搾取專利之剩餘價值。 (1175字；表3)
