據Strategy Analytics觀察統計2008年全球手機出貨量達11.78億支,但從2008第四季起手機成長已呈現負成長之勢。台灣過去素有「手機代工王國」的美譽, 2008年手機整體出貨量終於突破1億支,全球市占率也衝上13.8%。隨著智慧型手機市場需求放大,MIC估計2008年,台灣PDA手機出貨量約1200萬台,成長21.6%,以全球市場規模1700萬台計算,台灣PDA手機供貨量占全球高達七成。
全球通信技術發展快速,且技術都集中在美歐大廠手中,而手機代工幾乎是通信技術的後端應用之ㄧ環而已,極易陷入專利侵權或付出高額技術權利金,反而稀釋了台灣廠商之利益。台灣業者應該充分掌握住國際間專利訴訟資訊,避開大砲專利,降低威脅風險。
本調查以Stanford Law School所收錄聯邦地方法院訴訟資料為基礎,統計期間自2000年1月1日至2008年12月31日,全球各廠商提告有關通信類專利訴訟案件(US Patent Class 455: TELECOMMUNICATIONS),查得共計242案件,涉及爭議專利或訴訟引用專利數328個,如圖一。該通信類美國專利分類USP Class 455,參見表一:範圍說明。

該調查結果之中,有些專利更是大砲中的大砲,涉及多項案件及被告,如表二:Top15重量級大砲專利表列。此外,從該統計調查可看出,Ronald A. Katz Technology Licensing, L.P. 提告案件最多,共有109件,Rates Technology Inc有22件居次,Cygnus Telecommunications Technology, LLC有16件,Gammino 有8件,Antor Media Corporation有7件。 而台灣通信知名廠商被列名者也是有的。 以上訴訟調查,歡迎來洽詢及訂購。
