雲端服務平台專利確認之訴 Activevideo Networks控告Trans Video Electronics

2013年4月30日，總部位於美國加州的Activevideo Networks, Inc(下稱Activevideo)於加州北區地方法院，對總部位於華盛頓的Trans Video Electronics, Ltd(下稱TVE)，提起專利確認之訴(Declaratory Judgment)，要求法院審理其雲端服務平台相關技術不侵犯TVE的專利權(non-infringement)、該專利無效(invalidity)、以及該專利不可執行(unenforceability)，並要求訴訟律師費之補償。

根據訴狀指出，TVE曾於2013年4月11日，發出警告信函予Activevideo，認為Activevideo的產品有使用到其所擁有的US 5,594,936(‘936)與US 5,991,801(‘801)兩項專利，並要求支付權利金方可技術使用該技術，更於警告信函中指出蘋果公司(Apple, Inc)以及Direct TV等其他公司皆有支付上述兩項專利的權利金。

TVE於2006年開始，就曾以’936及’801兩項專利，對許多公司提起專利訴訟，相關訴訟整理如表三。據了解，在Trans Video Electronics, Ltd v. Sony Electronics, Inc.一案，法官於簡易判決(summary judgment)中，認定’801專利無效，原因是說明書所載的內容不明確(lack of written description)，該案也於2011年11月15日終止所有的審理程序。

本案系爭專利共兩項，第一項為美國專利編號US 5,594,936，名稱為全球數位影像新聞發佈系統(Global digital video news distribution system)，於1993年7月2日提出申請，1997年1月14日獲證；第二項為美國專利編號US 5,991,801，為’936的分割案，名稱與’936相同，於1996年8月9日提出申請，1999年11月23日獲證，專利權人皆為Trans Video Electronics, Ltd.。

An information distribution system for a digital network, includes a master communications unit for establishing communications with the network in order to receive a synchronous digital signal, a distribution amplifier unit for receiving and dividing the synchronous digital signal into a plurality of synchronous signals and a plurality of communications units for establishing communications with a plurality of receiving stations. The system also includes a master controller for controlling the plurality of communications units from a central location. The invention alternatively relates to an information disseminating system for a digital network and includes a plurality of video clip storing units, each storing data related to a particular subject matter, a plurality of distribution amplifiers associated with the video clip storing units and a plurality of communications units which establish communications between the plurality of distribution amplifiers and the digital network. A menu storing unit accessible from the digital network, stores information indicating the subject matter associated with each of the plurality of video clip storing units as well as information as to how to access each of the video clip units.	一數位網路的資訊發佈系統,包含一個主通訊單元,用以與網路建立通訊連線而接受一個同步數位訊號,一個發佈放大單元,用以接收該同步數位訊號並將其分割成複數個同步訊號以及複數個通訊單元, 用以與複數個接收站建立通訊連線. 本系統更包含一個主控制器,用以從中央站控制複數個通訊單元.另外,本發明係關於應用於數位網路的傳播系統,包含複數個影像晶片儲存單元每一儲存的影像資料與特定物件有關,複數個發佈放大器與影像晶片儲存單元相連,以及複數個通訊單元,用以使複數個放大器與數位網路建立連線.一選單儲存單元,由數位網路存取而儲存描述有特定物件的每一複數個影像晶片儲存單元及其相關資料得知如何存取每一影像晶片單元.

Activevideo Networks, Inc
總部設立於美國加州，主要產品稱為CloudTV，係提供一個開放式雲端平台，讓使用者可透過該平台，於雲端整合智慧電視、手持裝置、DVD播放器、錄放影機、遊戲及應用程式等設備或應用。

Trans Video Electronics, Ltd.
總部設立於華盛頓，創立於1992年，員工人數10人以下，經USPTO網站查詢，其下共擁有9篇專利。

觀察TVE過往的訴訟策略，其起訴的對象多半為提供雲端服務平台的知名公司，例如Apple的iTunes、Sony的playstation及google的playstore等服務平台，且從其不間斷的興訴過程可看出對自己的專利非常有信心，然而，觀察其訴訟歷史資料，卻也沒有看到對TVE較有利的判決結果，幾乎都以撤銷收場。Activevideo這次選擇積極的提出專利確認之訴，主要是為了避免市場上的傳聞影響本身的商譽，想要儘快釐清不確認因素，擺脫紛擾。(850字；表3)
