LTE標準必要專利訴訟 Evolved Wireless控告HTC等侵權

2015年6月25日,一家依據德拉瓦州州法設立、營業處所設在德州的專利授權公司Evolved Wireless, LLC (下稱Evolved Wireless),向德拉瓦州聯邦地院提起6起專利侵權告訴,分別控告Apple Inc.、宏達電(被告為HTC Corporation與HTC America Inc.,下稱HTC)、Samsung(被告為Samsung Electronics Co. Ltd.與Samsung Electronics America Inc.)、Lenovo(被告為Lenovo Group Ltd.、Lenovo (United States) Inc.與被Lenovo併購的Motorola Mobility LLC)、ZTE(被告為ZTE Corporation、ZTE (USA) Inc.與ZTE Solutions Inc.)、Microsoft(被告為Microsoft Corporation、Microsoft Mobile Oy與被Mircosoft所併購的Nokia Inc.)等大廠,其所製造販賣、支援長期演進技術(Long Term Evolution,LTE)功能之智慧型手機、平板電腦、無線網路通訊設備(例如路由器、熱點)等產品,直接與間接侵害了Evolved Wireless所擁有之五件專利權利。
 
據Evolved Wireless訴狀表示,其所擁有之包括五件系爭專利在內的LTE專利組合,原始權利人LG Electronics, Inc.(下稱LG),而LG在2004年2月7日將權利轉讓給一家名為TQ Lambda LLC的公司,而後者又在2014年9月26日將權利轉讓給Evolved Wireless。
 
Evolved Wireless指出,五件系爭專利對於3GPP(the Third Generation Partnership Project)之TS 36系列的標準,至少包括TS 36.211、36.300、36.321、36.331與36.423等,具備技術必要性之標準必要專利(standard essential patents,SEPs),有關於演進通用陸地無線存取網路(Evolved Universal Terrestrial Radio Access Network,E-UTRAN)之相關技術。
 
Evolved Wireless主張權利之五件系爭專利內容如下:
1. 美國專利編號US 7,746,916,名稱為「用來在一無線通訊系統中產生與傳送碼序列之方法與裝置(Method and apparatus for generating and transmitting code sequence in a wireless communication system)」,於2010年6月29日核發;
2. 美國專利編號US 7,768,965,名稱為「用來基於分段存取方案傳送與接收訊號的方法以及用來為同樣目的分配序列的方法(Method for transmitting and receiving signals based on segmented access scheme and method for allocating sequence for the same)」,於2010年8月3日核發;
3. 美國專利編號US 7,809,373,名稱為「在無線行動通訊系統中傳送與接收無線電存取資訊的方法(Method of transmitting and receiving radio access information in a wireless mobile communications system)」,於2010年10月5日核發;
4. 美國專利編號US 7,881,236,名稱為「資料傳送方法與同樣用途之使用者設備(Data transmission method and user equipment for the same)」,於2011年2月1日核發;
5. 美國專利編號US 8,218,481,名稱為「在行動通訊系統中傳送資料之方法(Method of transmitting data in a mobile communication system)」,於2012年7月10日核發。
 
以Evolved Wireless控告HTC之訴狀為例,Evolved Wireless在其中主張,HTC所製造販賣,具LTE功能並遵循LTE標準(至少包括TS 36.211、36.300、36.321、36.331與36.423)的手機、平板電腦與/或其他裝置產品,直接與間接侵害了系爭專利權利,特別是HTC誘使與輔助購買其產品之顧客直接侵害系爭專利權利,因此HTC必須負起間接侵權責任。
 
Evolved Wireless亦在其訴狀中主張,曾於2014年11月4日去函HTC America, Inc.,提出就系爭專利授權之FRAND(fair, reasonable and non-discriminatory)授權條件進行協商的邀約,並在2014年12月18日依據HTC之要求提供保密協議(non-disclosure agreement)文件,但HTC尚未簽署該協議使其生效,亦未與Evolved Wireless進行任何實質協商。Evolved Wireless進一步主張,其在2015年5月4日再度去函邀約HTC,就以FRAND授權條件授權其LTE專利組合進行協商。雖然Evolved Wireless持續就其LTE標準必要專利向HTC表達會提供FRAND授權之意願,但是HTC拒絕與Evolved Wireless進行任何實質的授權協商。 (1492字;表3)
