圖、智慧居家安全防護系統專利訴訟 MD Security控告Bright House Networks
2015年5月13日，剛於2015年2月18日依據美國德拉瓦州州法設立、營業處所亦設於德拉瓦州的專利授權公司MD Security Solutions LLC (下稱MD Security)，向美國佛羅里達州中區聯邦地院提起專利侵權告訴，控告提供有線電視、網路、電話等服務、美國第六大、佛羅里達州第一大的有線系統營運商Bright House Networks L.L.C. (下稱Bright House Networks)，其所提供的會居家防護系統產品，包括但不限於Bright House Networks Home Security，直接侵害了MD Security所擁有的一項專利權利，其所描述發明是有關使用行動偵測器與攝影機來保護建築物安全的安全系統。
本案系爭專利為美國專利編號US 7,864,983，名稱為「安全警報系統(Security alarm system)」，於2011年1月4日核發，發明人為Mark Dronge。系爭專利在申請時為美國專利申請案編號11/692,430 (現為美國專利編號7,526,105)的連續案(continuation)，其優先權日則主張為美國專利臨時申請案(provisional application)編號60/743,894的申請日2006年3月29日，以及美國專利臨時申請案編號60/804,660的申請日2006年6月14日。
MD Security在其訴狀中指出，Bright House Networks提供智慧居家防護系統產品給顧客，而這些顧客多數位於佛羅里達州中區聯邦地院的管轄區域內；Bright House Networks所提供的系統讓其顧客從其觸控式螢幕裝置控制居家防護系統，而這樣的技術功能便至少直接侵害了系爭專利的請求項1。
根據美國專利商標局(USPTO)的專利轉讓資料，系爭專利與US 7,526,105專利在2014年5月1日被發明人轉讓給專利授權公司Empire IP LLC (下稱Empire IP)。Empire IP在網站上所揭露、擁有權利的專利組合技術領域，其中便包括「安全警報系統」一項，而雖然其未揭露該專利組合中個別專利之編號，但Empire IP所描述該專利組合之技術特徵，與本案系爭專利可以說是相同。
根據RPX Corporation所建置NPE資料庫，則是將本案原告MD Security列為Empire IP的子公司。根據前述資料庫，Empire IP目前有33家已知的子公司，包括Potter Voice Technologies LLC、Data Speed Technology LLC、Rotatable Technologies LLC、Createads LLC、DietGoal Innovations LLC、SmartFit Solutions LLC、E-Contact Technologies LLC等，而Empire IP則是透過這些子公司來提起專利侵權之訴。(1024字；表2)
