監控軟體產品侵權Intellectual Ventures控告Symantec

2013年3月18日,知名專利授權公司高智發明(Intellectual Ventures)之子公司Intellectual Ventures I LLC (下稱IV),向美國德拉瓦州聯邦地院提起專利侵權告訴,控告全球最大防毒軟體製造商賽門鐵克Symantec Corporation(下稱Symantec),其所製造販售的資料儲存軟體產品(如Veritas Volume Replicator)與應用程式處理監控軟體產品(如Application HA),分別侵犯了IV所擁有之3項專利,其中前者產品被控侵犯美國專利編號US 5,537,533(’533專利)與US 6,598,131(’131專利)兩項專利權利,而後者產品則被控侵犯美國專利編號US 6,732,359(’359專利)之專利權利。

本案3項系爭專利內容如下:

’533專利名稱為「用來從一主要網路伺服器將數位資料遠端鏡像複製至一遠端網路伺服器的系統與方法(System and method for remote mirroring of digital data from a primary network server to a remote network server)」,於1996年7月16日核發,原始權利人為Miralink Corporation。在本專利原始權利人破產重整後,一家名為So. Pak Pte., LLC之空殼公司收購本專利而後移轉給IV;

’131專利名稱為「透過對不變性儲存裝置之仿真來進行資料影像管理(Data image management via emulation of non-volatile storage device)」,於2003年7月22日核發,原始權利人為Ondotek, Inc.。在本專利原始權利人倒閉後,IV透過一家空殼公司Oxtapro Tre ME, LLC購得本專利;

’359專利名稱為「應用程式處理監控程式(Application process monitor)」,於2004年5月4日核發,原始權利人為BellSouth Intellectual Property Corporation。本專利原始權利人將本專利出售給Dono Tech Services LLC,而該公司據悉也是IV進行專利收購的空殼公司之一。

以專利授權公司來說,IV表面上看來並非以積極或大量提起專利侵權告訴來做為主要營運策略,但是本案卻是IV二度控告Symantec專利侵權(2010年IV就多家資訊安全公司提起專利侵權告訴,Symantec便為其中之一,本案仍在繫訟中,案號為1:10-cv-01067-LPS)。

在本案訴狀中,IV特別提出Symantec在申請相關技術領域之專利時,曾引用過’533專利(如US 7,664,983)與’131專利(如US 7,673,130、US 7,702,892等 )做為先前技術文獻,所以Symantec對該2項專利內容應為知悉,而其被控侵權行為應構成美國專利法(35 U.S.C.§284 )所規定的惡意侵權(willful infringement)。(925字;表2)
