2013年3月28日Google在官網發佈「Open Patent Non-Assertion (OPN)Pledge」，也就是針對開放源專利不主張訴訟承諾的公約，以減少開源軟體（OSS）的專利攻擊，Google承諾對部分專利不會發起訴訟。除非Google先被攻擊，否則將不會針對開放源碼軟體的使用者、散布者，或開發人員提出基於特定專利的侵權告訴。
Google先提出十項免訴開放源專利，有關於分散數據處理技術「MapReduce」，今後Google還計劃進一步擴大Pledged Patents的範圍。

OPN Pledge倡導OSS是同時保護專利持有人能夠對抗訴訟攻擊，強調防禦性使用，有各種各樣的的OSS版權許可和授權組織提供專利權，例如Apache License 2.0和開放式創新網絡。Google聲稱已獲得贊同並擁護OPN Pledge的企業及組織，有：Cloudera、IBM和Open Invention Network（OIN）等。
市場上認為，Google是以廣告收益為主的公司，並不是藉由專利營利的公司；Google藉提供免費的Android平台以拓展廣告業務，卻招致各方業者的專利訴訟攻擊。Google提出OPN Pledge宣言，期盼為促進開放源軟體開放以降低Android平台面臨法律訴訟之威脅。宣示效果大於實質效益。(522字；表1)
