Canon 控告上海昊群數碼科技等公司的雷射印表機碳粉匣專利侵權 請求 ITC 調查

2012 年 1 月 25 日 , Canon Inc. ( 下稱 Canon) 於美國國際貿易委員會 ( 下稱 ITC) 指控 Clover Technologies ( 下稱 Clover) 、上海昊群數碼科技 (Orink Infotech, 下稱 Orink) 、 Nukote, Inc.( 下稱 Nukote) 與 17 間零售商 (Retailer) 的雷射印表機碳粉夾專利侵權，訴請 ITC 啟動調查並限制該些產品進口美國。

本案兩件爭議專利為 US5,903,803 與 US6,128,454 ，名稱為「碳粉匣，電子照相圖像形成裝置，動力傳動部分，與電子照相感光硒鼓」。其中， US6,128,454 是 US5,903,803 的分割案，兩案內容相同，僅申請專利範圍不同。該兩專利係由 Kawai Toshiharu ， Watanabe Kazushi 與 Ito Yoshihiro 共同發明，並由 Canon 分別於 1996 年 3 月 2 日與 1999 年 2 月 26 日申請，並於 1999 年 5 月 11 日與 2000 年 10 月 3 日取得專利權。

根據本案訴狀，由於被告生產或銷售的雷射印表機 (Laser Beam Printer) 碳粉匣的感光硒鼓 (photosensitive drum) 形成有一扭曲多邊棱鏡形 (twisted polygonal prism) 射出部 (projection) 。該射出部被用以插入雷射印表機的一個孔中，當該孔旋轉 (rotated) 時，射出部可使該感光硒鼓自動地固定並對齊於該雷射印表機之結構。

根據訴狀， Canon 宣稱 Clover 集團、 Orink 集團、 Nukote 集團與 17 間零售商製造或銷售的雷射印表機碳粉匣，使用了上述被專利保護的射出部；又由於 Canon 在美國境內已使用該專利技術製造了大量的碳粉匣，符合 337 條款國內產業之要件，因此請求 ITC 調查並發出一般性排除命令 (general exclusion order) 、限制性排除命令 (limited exclusion order) 與停止命令 (cease and desist order) 。

此外， 2010 年 7 月 30 日 Canon 也以相同的該兩項專利於 ITC 對中國納思達 (Ninestar Image International Ltd.) 提請 ITC 調查 (337-TA-731) ，並且在同一時間向美國紐約州地方法院提出侵權訴訟 ( Canon, Inc. v. Ninestar et al; 1:2010cv04999 ) 。並於 2011 年 6 月與該些公司達成和解。

Clover 、 Orink 、 Nukote 與先前被 Canon 提告中國納思達相同，都是雷射印表機碳粉匣的製造商，且各公司都推出與 Canon 雷射印表機相容的碳粉匣，極有可能使用爭議專利。然而爭議專利已於地院與 ITC 取得初步的勝利，並已授權給數間廠商，對被告而言，這場戰役似乎並不好走。 (678 字；表 1)
