2014年1月8日SimpleAir, Inc.(以下稱SimpleAir)，於美國東德州聯邦地方法院馬歇爾分院(United States District Court, The Eastern District of Texas Marshall Division)向Google Inc. (以下稱Google)與YouTube LLC (以下稱YouTube)提起專利侵權訴訟，指控Google)與YouTube所提供的多項系統與服務，侵害SimpleAir所擁有的US8,601,154 (以下簡稱’154專利)與US8,572,279 (以下簡稱’279專利)兩項美國專利。
SimpleAir是一家專利無實施實體(NPE)的專利授權公司，其自稱為「發明者權益技術授權公司」，目前擁有20多項無線傳輸系統、行動應用程式與推播機制之美國專利權。SimpleAir也曾對Microsoft與Apple等跨國公司提起專利訴訟，最後與Apple和解收場(註一)。本案兩項系爭專利名稱皆為「用於數據傳送之系統與方法(System and method for transmission of data)」，兩項專利皆是SimpleAir自原始發明人(同時也是專利權人)手中購得。
Google是網際網路搜尋引擎、雲端服務巨擘，YouTube則是設立於美國的一個影片分享網站，創立於2005年。2006年11月，Google以16.5億美元收購YouTube，故現在Youtube為Google旗下的子公司。
SimpleAir指控YouTube所提供的YouTube services，以及Google的產品與服務，包括Gmail、Google+、Google Talk、Google、Hangouts、Google Calendar、Google Cloud Message for Chrome系統與服務、Google Cloud Messaging (GCM) 系統與服務以及Android Cloud to Device Messaging (C2DM)系統與服務中，皆使用了SimpleAir兩項系爭專利技術，YouTube與Google未經SimpleAir同意授權，即利用其專利技術製造、使用系爭侵權產品，以直接侵害SimpleAir專利權。SimpleAir求Google與YouTube支付專利侵害損害賠償。(608字；表2)
