行動裝置GPS定位專利訴訟Pragmatus控告Samsung等多家公司

2013年10月10日，總部位於維吉尼亞州的Pragmatus Mobile LLC（下稱Pragmatus），，向德拉瓦州聯邦地方法院（District of Delaware）提起訴訟，控告電子大廠三星Samsung Electronics Co. LTD（下稱Samsung）及其美國子公司，所販售的智慧型手機（Smartphone），直接和間接侵害其專利權。Pragmatus除要求法院禁止Samsung的侵權行為外，並要求Samsung負起損害賠償的責任。

原告Pragmatus成立於2012年，其幕後的大老闆是知名專利授權公司Intellectual Ventures（註1）。一個半月前，Pragmatus曾經以同樣的專利在美國國際貿易委員會（ITC）告過Samsung的老同鄉Pantech（337-TA-889）；一個月後的今天，Pragmatus整裝再出發，不只Samsung倒楣，許多科技大廠也遭受池魚之殃。

訴狀中，Pragmatus宣稱，Samsung於其專利存續期間，未經許可，於美國境內製造、使用、邀約銷售或銷售，已獲准專利的發明技術或產品，及（或）進口該技術或產品至美國，直接和間接侵害其專利權。

本案兩項系爭專利主要是關於，如何利用GPS（Global Positioning System）來追蹤行動裝置位置的方法。其中，第二個專利是第一個專利的連續案。

• 美國專利編號US 8,149,124，專利名稱為「人身安全和追蹤系統（Personal Security and Tracking System）」，於2012年4月3日核發，是由David Doe等人所研發的專利，原專利權人是Pragmatus。Pragmatus指控Samsung侵害其第一個權利項的技術。
• 美國專利編號US 8,466,795，專利名稱為「人身安全和追蹤系統（Personal Security and Tracking System）」，於2013年6月18日核發，是由Mark Hoffman等人所研發的專利，原專利權人是Pragmatus。Pragmatus指控Samsung侵害其第27個權利項的技術。

10月10日當天，Pragmatus除了告Samsung外，還以相同系爭專利告了其他四家大廠。其中，HP和Dell被控侵權的產品是平板電腦；Nokia和ZTE則是手機。

目前，台灣廠商參加Intellectual Ventures會員有四家：南亞科技、緯創資通、中華映管、及宏達電。推測Pragmatus公司應該是代表Intellectual Ventures其中之一的GPS專利組合任務團隊；未來，Pragmatus可能會再利用本案及相關案共計數個系爭專利，向行動裝置廠商發起第三波GPS定位專利訴訟，藉專利訴訟積極招募會員。（866字；圖1；表3）
