2013年5月31日,美國紐澤西州發明人Craig Thorner(下稱Thorner)對知名電腦商微軟公司(Microsoft Corporation)提起專利侵權之訴,指控微軟公司侵害其所持有的US 6,422,941、US 8,308,558及US 8,328,638三項專利(系爭專利),原告據以請求損害賠償及禁制令。全案由美國紐澤西州地方法院負責審理。
系爭三項專利皆為有關觸覺產生器以及利用該觸覺產生器於電玩遊戲、軟體、控制器之方法。具Thorner訴狀指出,微軟公司所產製、販售的XBOX和XBOX 360遊戲機、遊戲控制器以及遊戲介面裝置(系爭產品)等侵害系爭專利。
