2012 年 9 月 18 日，甲骨文公司 (Oracle Corporation 以及 Oracle America, Inc.) 向美國德拉瓦州聯邦地院提起確認告訴，甲骨文主張所設計開發並銷售的網路應用程式開發工具 Application Express(APEX) 軟體、並未侵犯被告專利授權公司 Advanced Dynamic Interfaces LLC( 下稱 ADI) 所擁有的兩項為關聯式資料庫自動產生圖像式使用者介面之技術專利權利，以及宣告該兩項專利無效。
本案的緣起是在 2012 年 7 月 20 日， ADI 向德拉瓦州聯邦地院提起專利侵權告訴 ( 案號為 1:12-cv-00963-GMS ，下稱 APEX 使用者訴訟 ) ，控告 Aderas, Inc. 、 Apps Associates LLC 、 Konoso LLC 等 20 家公司 ( 但其中針對 GB Advisors LLC 之告訴被撤銷後剩 19 家公司為被告 ) ，其使用 APEX 軟體或從事涉及 APEX 軟體之行為侵犯本案系爭專利權利。但 ADI 在 APEX 使用者訴訟中卻未將 APEX 軟體之所有權人與設計開發人甲骨文公司列為被告，雖然在該訴訟中 ADI 主張 APEX 軟體本身涉及侵犯系爭專利權利。
甲骨文在本案訴狀中主張， APEX 軟體為 ADI 在 APEX 使用者訴訟中主張專利權利受到侵犯的關鍵，而該訴訟中部分被告也因為該訴訟向甲骨文提出賠償的要求，所以 ADI 主張其專利受到侵犯之提告，對甲骨文產成實質而切身的損害，該損害包括暗示甲骨文銷售 APEX 軟體之行為構成間接侵權、對於開發使用與銷售 APEX 軟體等行為是否構成侵權的不確定性、 APEX 使用者訴訟以及其他使用者亦可能被告之威脅性對於 APEX 軟體市場行銷之負面影響、以及甲骨文公司後續可能必須擔負之賠償責任等。基於上述理由，甲骨文主張法院就其請求有管轄權進行審理。
本案所涉之兩項系爭專利為： 於 2006 年 6 月 13 日核發之 美國專利編號 US 7,062,502 專利，以及 於 2008 年 7 月 15 日核發之 US 7,401,094 專利，名稱均為 「為關聯式資料庫管理系統自動產生動態資料輸入之使用者介面（ Automated generation of dynamic data entry user interface for relational database management systems ） 」，發明人均為 John N. Kesler 。
被告 ADI 設立於德州，根據資料顯示該管理人是位律師 Brent Farney ，而該律師同時也是數間營業地址與 ADI 相同之有限公司 (LLC) 的管理人，包括 Associated Annotations, LLC 、 Cgr Technology Investments, LLC 等。 (859 字；表 3)
