2012年7月12日，依據美國密西根州法律所成立並受該州法律規範的資產信託公司Relume Corporation Trust以及該信託之受託人Denny Foy、Shawn Grady與Marie Hochstein(下稱原告Relume等)，向密西根州東區聯邦地院提起專利侵權告訴，控告光林電子(Leotek Electronics USA Corp.)所製造販售之LED交通號誌燈模組產品，侵犯原告RCT等所受託之一項智財信託財產也就是LED陣列供電裝置有關的專利權利。
同一天，原告Relume等亦在美國德拉瓦州聯邦地院提告，控告美國市占率第一之LED路燈與交通號誌燈供應商GE Lighting Solutions LLC公司所製造販售的LED交通號誌模組產品，侵犯同項專利權利。
本案系爭專利為美國專利編號US RE42,161，名稱為「LED陣列之電力供應(Power supply for light emitting diode array)」，於1997年8月26日核發，也是美國專利編號US 5,661,645專利的再核發專利(reissue，再核發期日為2011年2月22日)，發明人Peter Hochstein，權利人則為Relume Corporation設立於密西根州，製造販售LED相關產品。
本案系爭專利之再核發申請於1999年8月24日提出(在原專利核發後兩年內)，其申請增加請求項24至39，主要內容是將系爭專利技術應用於LED戶外號誌燈設備上，而原告在其訴狀中，亦特別指明被告之系爭產品至少侵犯了再核發專利所新增的請求項24、25、26、27與31。[註：RE42161 claims 1~23都以中刮弧標註, 代表reissue專利中已經刪除這些項次的claims，Claim 24以後斜體新增的claims才是目前有效的專利範圍，所以訴狀中, 原告主張的是claims 24, 25, 26, 27 & 31.]
光林電子(Leotek Electronics USA Corp.)是美國市占率第二之LED路燈與交通號誌燈供應商，也是台灣光寶集團在美國購併並持股72%之子公司。
資產信託公司Relume Corporation Trust，2008年3月成立於Delaware，前身即是Relume Technologies, Inc.，也是Relume Corporation。其信託契約於2009年6月1日成立，所以做為信託財產之本案系爭專利，財產權依契約進行實質移轉。而本案告訴則是由三名受託人所提出。本案原告信託之三名受託人中，Marie Hochstein是繼承於2011年逝世之原受託人Peter Hochstein的權利義務而成為受託人，而這樣的法律關係即為專利發明人將專利權利移轉給其所創辦之公司後，該公司再信託該權利給發明人與其他受託人進行管理。
後註：有關本案所涉專利信託的部分，因無法得知信託契約內容與法律關係(例如信託受益人是誰等問題)，所以也無法得知信託後是否有進行其他專利應用的佈局(例如證券化等)或是出自有任何管理上的原因(例如破產隔離或者對抗債權人效力等)。不過，可以確定的就是該案原告是系爭專利之受託者，在財產權因為信託成立而實質移轉之下，取得起訴權。(789字；表2)
