手機通信專利訴訟，Mobile Enhancement Solutions LLC控告HTC、Apple及Motorola專利侵權

2012年3月15日，設置於美國德州(Texas)Frisco的Mobile Enhancement Solutions LLC(下稱MES)於美國德州北區地方法院指控通信產品製造廠商HTC、Apple及Motorola 等公司的行動通訊產品侵害其專利權。

根據訴狀所述，原告MES分別對HTC Corporation及HTC America, Inc(以下合稱HTC)；Apple Inc.(以下稱Apple)；Motorola Mobility, Inc.(以下稱Motorola)及其合作的行動通信服務業者提出控訴，被控的行動通信服務業者廠商包括AT&T Inc.及AT&T Mobility(以下合稱AT&T)；Verizon Communications Inc.及Cellco Partnership Inc. d/b/a Verizon Wireless (以下合稱Verizon)；Sprint Nextel Corporation及Sprint Spectrum L.P.(以下合稱Sprint)等。AT&T、Verizon及Sprint為美國前幾大行動通信服務業者。根據訴狀中所述，被告HTC、Apple及Motorola在美國德州東區地方法院的管轄區域內，以製造、使用、販賣之要約(offered for sale)、販賣及/或進口等行為進行侵權。

本案對HTC及Motorola的系爭專利有4件，對Apple的系爭專利除了前述4件外另有2件共6件，6件系爭專利的編號分別為：US7,096,033(下稱033)、US6,879,838(下稱838)、US7,317,687(下稱687)、US6,415,325(下稱325)、US6,148,080(下稱080)以及US6,094,648(下稱648)。033、838、687及325為相同的4件系爭專利。原告MES在訴狀中聲明，MES為系爭專利的持有人，並享有排他權。據本網站調查，此6件系爭專利原為Phillips公司所持有，分別在2000至2008年間獲得。

US6,879,838: “Distributed location based service system”(基於服務系統的分散位置)
US7,317,687: “Transmitting data frames with less interframe space (ifs) time”(以較少訊框間隔時間傳送資料訊框)
US6,415,325: “Transmission system with improved synchronization”(具同步改善的傳輸系統)
US6,148,080: “Mobile telephone with amplified listening”(具擴音聽的行動電話)
US6,094,648: “User interface for document retrieval”(文件擷取的使用者介面)

根據MES在訴狀中指稱，被告HTC、Apple及Motorola所生產的多款行動裝置與AT&T、Verizon及Sprint所合作的通信模式與功能侵害權利項如下表。原告MES請求美國德州東區地方法院判決被告HTC、Apple、Motorola及所合作的行動通信服務業者賠償損害並在未來給付授權金。

本案是以通信方式綁定特定通信專利，向手機大廠索討授權金的專利訴訟，後續發展值得關注。

Mobile Enhancement Solutions LLC是一家專利授權公司，它的專利來源主要來自IPG Electronics 503 Limited公司，而IPG又輾轉向Philips Electronics取得。企業將非核心智財專利轉讓出去，並將無形資產變成貨幣，又能向大廠每年收取授權金，也是一種不錯收入。(723字；表1)
