網路容錯與熱切專利訴訟，Acceleron,控告Microway等伺服器商

2012年3月9日，位於德州的專利授權公司 Acceleron, LLC，向喬治亞州北部聯邦地方法院提起專利訴訟，控告 Microway, Inc. 侵犯其網路容錯與熱切換的專利。

本案系爭專利有一項：U.S. Patent No. 6,948,021, 標題為 “Cluster Component Network Alliance System and Method for Enhancing Fault Tolerance and Hot-Swapping” (叢集元件網絡聯盟系統及提高容錯與熱切換的方法) (以下簡稱021專利)。 021專利的發明人為 Joel Brian Derrico 及 Paul Jonathan Freet，此專利係依據2000年11月16日的臨時申請案為基礎，於2001年11月16日提出專利申請，在2005年9月20日獲得核准。原專利權人為 Racemi Systems公司，在 2007年5月31日Acceleron 公司取得 021專利。

本案所涉及的產品為被告 Microway, Inc. 的 Microway’s NumberSmasher and Navion clusters and servers。(見下圖)

原告 Acceleron LLC (http://acceleronllc.com/) 是一間專利授權公司，在德拉威州成立且總部設於德州。 Thomas B. Ramey, III, 是 Acceleron 公司的總經理。Acceleron 公司在 2007年5月31日取得 021專利。 Acceleron 就同021專與HP公司有專利訴訟，亦相繼於2012年3月13日、19日及20日在同一聯邦地方法院（喬治亞州北部聯邦地方法）以同一專利，對 Technology, Inc. 、Appro International, Inc.、AMAX Information Technologies, Inc. 及 Bull HN Information Systems, Inc. 提起專利訴訟。

被告 Microway, Inc. (www.microway.com) 是在1982年7月成立於德拉威州的公司，主要營運地點在麻州，從事叢集網路/伺服器及相關軟件的技術開發。(426字；表2；圖1）
