2011年4月8日，位於美國加州的專利控股公司Resonant Biotechnologies以1項專利侵權為由，控告特殊玻璃及陶瓷材料製造商康寧(Corning)以及多家知名藥廠，其中前陣子因流感疫苗而聲名大噪的諾華藥廠(Novartis)也名列本次被告清單，全案將由德拉瓦州聯邦地院負責審理調查。
本案系爭專利編號為US6,218,194 (Analytical methods and apparatus employing an optical sensor device with refractive index modulation)，專利發明人為Nikolai Mikhailovich Lyndin等4位俄羅斯人，原專利權所有人英國公司Thermo Fast UK Limited，後來移轉給原告Resonant Biotechnologies，專利主要涉及透過光波導覽及折射角的應用，使光學傳播感應儀器對生物進行更精確的研究與觀察。
本案訴訟案主要導因於康寧所研發的生物用藥反應觀測系統The EpicR System，該平台透過光學傳感技術(optical sensor device)對生物進行藥物反應測試，同時直接觀察生物間的藥效交互作用，進而提升研究人員對於藥物的風險評估管理及開發能力。在其他被告方面，主要負責生物實驗儀器製造的PerkinElmer因協助康寧進行開發The EpicR System而成為被告，其他包括諾華在內的5家藥廠則因使用了該項系統進行藥物測試，而一併被告上法院。(398字；表1)
