2010年3月22日專利授權公司Promote Innovation LLC (以下簡稱：Promote Innovation) 於Texas Eastern聯邦地院提告Toshiba Corporation等多家便攜式電子產品廠商侵權，有關於侵權產品侵犯了專利標示不實罪(falsely marking their products)，涉及四項專利號碼(US4,631,603、US4,577,216、US4,819,098、US4,907,093)。
據本案原告訴狀指稱，依據美國專利法35 U.S.C. § 292中關於不實專利標示(false patent marking)的懲罰金計算方式認定為罰金之計算是以每一個標示錯誤專利資訊的產品為基礎，要求法院對專利資訊標示不實或錯誤之產品或包裝處以最高美金$500的賠償罰金。
