2009年3月20日BackWeb Technologies公司對微軟(Microsoft Corporation)提出告訴，在美國北加州地方法院（Northern District of California）提出對微軟的BITS（Background Intelligent Transfer Service）、Windows Update和其它產品侵犯了BackWeb的4項專利。這些專利主要涉及遠端網路與本端電腦主機之間的信息傳送(Method and apparatus for transmitting and displaying information between a Remote Network and local computer)和分散式客戶端數據緩存系統(Distributed client-based data caching system)，BackWeb宣稱微軟使用這些技術用於微軟Windows、Office等產品的自動更新技術。

BackWeb Technologies公司位於美國聖荷西，隸屬於BackWeb, LTD設於以色列的科技公司，早期以網路通信PUSH技術領先的廠商。
