GPS導航專利訴訟之爭：微軟與TomTom

2009年2月25日微軟(Microsoft Corporation)分別向美國國際貿易委員會(ITC)及美國華盛頓州西區聯邦地方法院（Western Washington），對GPS導航廠商TomTom提出專利侵權訴訟，本案系爭專利有8個專利。其中五個與汽車導航（ＧＰＳ）有關，三個則與TomTom在產品中使用的Linux檔案管理技術有關，這也是微軟首度針對Linux核心侵權對廠商提出告訴。在ITC訴狀裡提及爭議專利有5個專利，聯邦地院除這5件外，還多了3件：US6,704,032、US7,117,286、US6,202,008。

微軟針對聯邦法院提出的官司是要尋求賠償，而針對ITC方面提出的官司則要求禁止進口侵權產品。由於，這是微軟首度針對Linux核心侵權對廠商提出告訴，此舉動引起Linux社群及開放原始碼人士，產生極度關注，是否會對自由軟體運動產生些影響，靜觀其變。

後續報導(2009/03/23)

接著，TomTom不示弱地反擊了，於2009年3月19日，向微軟以侵害其專利為由，在美國維吉尼亞東部地區聯邦地方法院對微軟提出反訴。TomTom認為其4項專利受到了微軟的產品“Microsoft Streets and Trips”的侵權，要求賠償損失。參見表三。

後續報導(2009/04/01)

針對337調查部分，微軟已於2009/03/27先向ITC請求撤回對TomTom的告訴(案號Docket #2654)。由此可看出，雙方可能已達成協議。
