企業經營除追求獲利外，對於經營風險控管（Risk Management）也是核心議題之一。
經營風險即是企業經營時，外部不可掌握之不確定性，從大面向的全球經濟、社會環境與人口結構及國際產業趨勢變化，小至企業面臨區域市場變化或是產業鏈各環節激烈競爭，甚至以侵權訴訟為手段的專利攻擊等都是重要的風險來源。

對於以ICT產業生產製造及外銷為骨幹的台灣產業而言，國際專利侵權訴訟風險更是心中大痛。不論是過去半導體製造、半導體設計、顯示器、光電顯示元件與近期品牌經營，幾乎少有 任 一主流產業倖免。當原本ICT產業切入下次代產品，或一窩蜂前進車用電子與數位住宅戰場時，虎視眈眈的專利擁有者已磨刀霍霍。
專利侵權訴訟風險已成一大憂患，企業對於預測、控制與規避風險將視為支援決策機制的重要關鍵。若要預測大環境景氣可能不容易，但要知道相關產品賣到國際市場而可能產生侵權訴訟的機率，可就相對簡單多了。鑑往知來，觀微知著，看看產業鏈近期全球訴訟狀態，看看上下游廠商近期專利議題，會不會被告，在哪裡被告大概也八九不離十。
車用電子（Car Electronics）熱門程度業界都感受到，但若說過去一個星期就有三件與車用電子相關訴訟在美國東德州聯邦地方法院發生，大家可能就有些訝異了。2008年9月2日，Mobile Micromedia Solutions控告BMW與Hyundai Motor侵犯US5,420,931與US5,722,069兩件專利；2008年8月29日，Affinity Labs of Texas 控告Alpine Electronics等7家侵犯US7,324,833專利；2008年8月27日控告ATX Group; BMW; Cross Country; Toyota Motor等四家公司侵犯US7,050,818專利，彙整如表一所示。
在Mobile Micromedia案件中，Mobile Micromedia先前也在2008年3月19日
與2007年10月26日分別控告Nissan與General Motors侵權，受爭議專利均為US5,420,931。Affinity Labs of Texas案件中，Affinity Labs of Texas已於2008年8月27日與25日控告BMW 與Honda等13個公司與Dice Electronics、Jwin Electronics、TomTom與VAIS Technology等四家公司。
在三件主要訴訟案中，Mobile Micromedia技術與車用多媒體，特別是影音媒體相關，Tendler Cellular 技術與GPS及Location Based Service相關，Affinity Labs of Texas技術與將Portable device連結至車用音響相關。
