新聞:(2006年07月28日 - Mosaid指控侵權 力晶:未在專利註冊地銷售)加拿大半導體設計公司Mosaid指控美光、台灣的力晶(5346)和茂德(5387)侵犯電腦記憶晶片專利。力晶副總兼發言人譚仲民表示:MOSAID的專利是在美國註冊登記,但力晶的產品並沒有直接賣到美國和加拿大,更沒收到訴狀,如果MOSAID確實要提起訴訟,力晶會有適當反駁與回應,不致造成重大影響[1]。

評析:這是個有趣的新聞,我們來追蹤一下。7月27日力晶於《公開資訊觀測站》澄清說明如下,發言人為譚仲民副總[2]
關於MOSAID Technologies宣稱已於美國德州對力晶提出侵權告訴,本公司尚未接獲相關訴狀,對於該公司所稱專利內容尚待進一步了解。但根據新聞,MOSAID之專利係於美國地區登記,而力晶公司並未直接在美國市場銷售DRAM產品,該專利訴訟對本公司影響應屬十分有限。力晶將會針對相關法律資料展開研究,並將視需要採取回應措施。根據Mosaid與Infineon在今年6月14日所達成的專利訴訟和解協議來看[3],力晶要躲過這個專利訴訟案的可能不高,因為如果連Infineon與Samsung此二DRAM巨人都已經接受Mosaid的授權了,力晶又有何能耐免除。換言之,下一步需要討論的問題僅在於要付多少錢罷了。
專利為屬地主義,且該專利訴訟是在美國進行沒錯,但是不要忘了Mosaid的專利是全球佈局的。如表一就是Mosaid在中國所申請之專利。此外,如果加上今年六月購買自Infineon與Qimonda的50個專利,則Mosaid的基本專利數量也超過250個以上,考量同一基礎專利的全球專利家族,全部專利數量應該超過600個以上,其他Mosaid專利基本資訊如表二所示。
力晶產品沒有直接賣到美國不代表不會侵權,因為專利所排除他人的範圍包括製造、販賣、使用與進口等。換言之,如果委由力晶代工的公司被告,力晶最終仍脫離不了關係。最後,充實自身專利組合是短時間重要工作(到7月28日止,力晶在美國核准專利已超過130個),而談到一個可接受價錢,更需要一個好的談判策略。(740字)
