圖、VideoLabs控告宏碁、華碩、微星、聯想與摩托羅拉侵害H.264視訊技術相關專利

專利聚合業者（Patent Aggregator）VideoLabs於2022年7月1日向美國國際貿易委員會（USITC）遞狀提起337訴訟，主張宏碁、華碩、微星、聯想與摩托羅拉等5家公司進口到美國境內販售的筆記型電腦與智慧型手機產品，侵害其所擁有的4件視訊處理相關專利。USITC於8月3日決定立案開始調查此專利侵權情事，調查案號為337-TA-1323。

另外於USITC提起訴訟的前一日，VideoLabs也依據相同4件專利，於6月30日向德州西區聯邦地方法院，針對相同5家公司分別提起專利侵權訴訟。該4件系爭專利原始專利權人來自Panasonic及Samsung Electronics。

專利聚合業者VideoLabs背景介紹
VideoLabs以一種Patent Aggregator新態樣的專利授權商業模式出現。根據VideoLabs官網介紹，全球有超過170萬件視訊技術相關專利處於有效狀態，但其中實際被應用於業界產品上的高商業價值/高風險的視訊專利權僅是其中的少數。VideoLabs團隊建購專利授權平台對視訊技術專利進行編目和分析，能有效判斷對哪些是高價值/高風險專利，哪些是沒有影響的專利。亦即VideoLabs企圖成為視訊技術關鍵領域的獨立且值得信賴的顧問，採用會員年度收費制從兩方面：

（1）Provide efficient access to the highest value patents in the industry
找尋並確認辨識出視訊技術相關的關鍵專利，將這些關鍵的視訊技術專利收集彙整到VideoLabs授權平台中，一方面使專利所有權者能夠更有效率地獲得專利權利金收益，另一方面使需要運用相關專利技術者能取得關鍵專利授權。
（2）Provide companies innovative alternatives for dealing with low-value patents and frequent nuisance-level patent assertions.
當專利蟑螂提起騷擾性質專利訴訟時，協助公司對抗專利蟑螂所主張的低價值視訊技術專利，避免不必要的訴訟風險或高額授權談判交易成本。VideoLabs 承諾將大部分收入用於持續清理排除無效專利（ongoing clearance）。

自成立以來，VideoLabs已累積取得來自諾基亞公司（Nokia）、阿爾卡特朗訊（Alcatel-Lucent）、西門子公司（SiemensAG）、瑞士電信公司（Swisscom AG）、3Com、松下（Panasonic）、三星電子和惠普企業 (Hewlett Packard Enterprise, HPE) 的數百項專利權。

VideoLabs認為，傳統式以單純會員年費收入應該並不足以支持VideoLabe進行上述（1）（2）兩項業務，因此除了已經成功地將相關專利授權給包括迪士尼在內的多家公司；在過去 18 個月中，VideoLabs 更積極地主動出擊展開維權活動，分別對亞馬遜（Amazon）、戴爾（Dell）、臉書的母公司Meta 和影音串流平台 Netflix 提出了專利侵權訴訟；現在更進一步擴大對主流產品的個人電腦和智慧型手機提出侵權訴訟。(2550字；圖1)
