數位電視ATSC與MPEG2標準專利訴訟MPEG LA控告Sceptre

2014 年 6 月 26 日，三菱、通用、飛利浦、松下以及 Thomson Licensing 等 5 間同屬 MPEG LA 專利聯盟的公司 ( 下稱原告 ) 向加州中區聯邦地方法院 (California Central District Court) 控告 Sceptre, Inc.( 下稱 Sceptre) 侵權，認為 Sceptre 生產、製造與銷售的各型電視侵犯原告的 7 項專利權，且係爭專利是 MPEG-2 的標準專利。

2014 年 7 月 2 日，同屬 MPEG LA 的其他成員也向加州中區聯邦地方法院對 Sceptre 提起侵權訴訟， Zenith Electronics LLC et al v. Sceptre, Inc. ，案號 2:2014cv05150 ，系爭專利是 US 5,802,107 、 US 5,629,958 和 US 5,684,541 ，屬於數位電視 ATSC 標準專利，此三項系爭專利也出現在 2013 年 6 月 4 日 Zenith Electronics LLC et. al. v. ViewSonic Corporation 一案，案號 0:2013cv61237 ，當時被告為 ViewSonic ，在 2014 年 2 月 4 日裁定轉移管轄權到加州中區聯邦地方法院，新案號是 2:14-cv-00845[ 註 1] ，因 ViewSonic 與 MPEG LA 簽訂專利授權契約，本案已關閉。

MPEG-2 和 ATSC 標準專利由標準專利聯盟 MPEG LA 授權，成員涵蓋前述案件之原告。在 2014 年 7 月 7 日， MPEG LA 發布新聞稿表示對 Sceptre 提起訴訟，指稱 Sceptre 在美國銷售的產品包括數位電視機在內，侵犯 MPEG-2 數位視訊壓縮標準以及 ATSC 數位廣播標準的關鍵專利且未獲得授權，所指的訴訟即為本案和 2:2014cv05150 一案。訴狀指出，取得 MPEG-2 授權的廠商有近 2000 間，而 Sceptre 不願意參與授權，故被提起訴訟。在 2011 年 10 月 11 日時， Sceptre 曾被美國加州的專利授權公司 Technology Licensing Company 控告，案號 3:2011cv05017 ，最後雙方和解收場。

本案系爭專利共有 7 件，分別是：

US 7,376,184 ，專利名稱為「高效率編碼器和視訊的記錄與重製裝置 (High-efficiency encoder and video information recording/reproducing apparatus) 」，於 2008 年 5 月 20 日通過實體審查並公告，共有 3 個權利項，其中第 1 、 2 、 3 項是獨立項，原始專利權人是三菱。
US 6,097,759 ，專利名稱為「影像訊號編碼系統 (Image signal coding system) 」，於 2000 年 8 月 1 日通過實體審查並公告，共有 10 個權利項，其中第 1 、 4 項是獨立項，原始專利權人是三菱。
US 5,606,539 ，專利名稱為「用於編碼和解碼音頻 / 視頻信號的方法和裝置及該些裝置的記錄載體 (Method and apparatus for encoding and decoding an audio and/or video signal, and a record carrier for use with such apparatus) 」，於 1997 年 2 月 25 日通過實體審查並公告，共有 29 個權利項，其中第 1 、 18 、 23 、 29 項是獨立項，原始專利權人是飛利浦。
US 5,459,789 ，專利名稱為「電視節目訊息包元件檢測器 (Packet TV program component detector) 」，於 1995 年 10 月 17 日通過實體審查並公告，共有 12 個權利項，其中第 1 、 9 、 12 項是獨立項，原始專利權人是 Thomson Consumer Electronics ，後來移轉給 Thomson Licensing 。
US 5,491,516 ，專利名稱為「視頻壓縮 / 解壓縮系統場消除系統 (Field elimination apparatus for a video compression/decompression system) 」，於 0996 年 2 月 13 日通過實體審查並公告，共有 4 個權利項，其中第 1 、 2 、 4 項是獨立項，原始專利權人是 Rca Thomson Licensing Corporation ，在 2001 年 4 月 26 日移轉給通用。
US 5,784,107 ，專利名稱為「用於圖像編碼和解碼的方法及設備 (Method and apparatus for picture coding and method and apparatus for picture decoding) 」，於 1998 年 7 月 21 日通過實體審查並公告，共有 12 個權利項，其中第 1 、 5 、 9~12 項是獨立項，原始專利權人是三菱。
US 5,481,553 ，專利名稱為「運動圖像變換係數逆變換時防止舍入誤差的方法和設備 (Methods and apparatus for preventing rounding errors when transform coefficients representing a motion picture signal are inversely transformed) 」，於 1996 年 1 月 2 日通過實體審查並公告，共有 47 個權利項，其中第 1 、 10 、 16 、 17 、 21 、 22 、 28 、 34 、 36 、 38 、 43 項是獨立項，原始專利權人是 Sony 。

表三是本案系爭專利相關訴訟清單，可見各別專利曾出現在多個訴訟中。 2009 年 2 月 27 日的 Cif Licensing 對 Lenovo 一案 ( 案號 7:2009cv01849) ，已於 2011 年 3 月 24 日在初始階段關閉 (Closed in Initial Pleadings) ； 2008 年 2 月 20 日的 CIF Licensing, LLC et al v. ATI Technologies, Inc. ，也在 2008 年 12 月 10 日初始階段關閉 (Closed in Initial Pleadings) ； 2008 年 6 月 2 日的 Mitsubishi Electric Corp. et al v. Vizio, Inc. ，在 2008 年 11 月 18 日在初始階段關閉 (Closed in Initial Pleadings) ； 2009 年 8 月 12 日的 British Telecommunications Plc et al v. Haier America Trading, LLC et al ，在 2011 年 7 月 20 日庭審前關閉 (Closed in Pretrial) 。

2008 年 4 月 17 日的 Mitsubishi Electric Corporation et al v. Target Corporation and Doe Corporations 1-10 ，已於 2008 年 10 月 14 日在庭審前關閉 (Closed in Pretrial) ， MPEG LA 在於 2008 年 10 月 17 日發布新聞稿表示 Target Corporation MPEG-2 專利組合授權，為其自有品牌的 MPEG-2 產品支付權利金，其中包括以 Trutech 商標出售的數位電視和 DVD 播放機，受本協議影響，數家透過 MPEG LA 獲取核心 MPEG-2 專利授權的公司退出該侵權訴訟案。

2014 年 2 月 6 日的 Mitsubishi Electric Corporation et al v. ViewSonic Corporation 一案，在 2014 年 5 月 15 日權利項解構時關閉 (Closed in Claim Construction) ， MPEG LA 在 2014 年 6 月 19 日發布新聞稿說明 ViewSonic 已加入 MPEG-2 和 ATSC 專利組合授權。基本上，只剩剛興訟的本案還在進行中，其餘案件都在雙方合意下終止，對以收取權利金的 MPEG LA 來說是樂見的結果。 (1872字；表2)
