2014年2月13日Touchpac Holdings, LLC (以下稱Touchpac)，於美國麻薩諸塞聯邦地方法院(The District of Massachusetts)向Touchbase Technologies, Inc.(以下稱Touchbase)提起專利侵權訴訟，指控Touchbase所提供的電子商務名片侵害Touchpac所擁有的US8,497,850 (以下簡稱’850專利)美國專利。
本案系爭’850專利名稱為「藉由一電容式觸控螢幕從一資訊載體取得資訊之系統與方法(System and method for retrieving information from an information carrier by means of a capacitive touch screen)」，專利技術是涉及利用不同介電係數或是導電係數之材質，可將資訊紀錄於該資訊載體內，並透過觸控螢幕，即可讀取該資訊載體內之資訊。’850專利原權利人為德國公司printechnologics GmbH，2013年printechnologics被T+ink 取得，共同合作發展特殊印刷技術。
Touchpac則是T+ink全資擁有的子公司，目前 printechnologics已取得及申請中的美國專利皆已讓渡給Touchpac主張專利權。printechnologics利用本案系爭專利技術發展之實體產品名為TouchCode，TouchCode也已成為註冊商標，該技術能夠將電子資訊隱藏記錄在普通紙面上，且不影響紙面上之印刷文字，只要透過智慧型手機的觸控螢幕即可讀取其中隱藏的訊息，包括靜態與動態視頻等訊息。
Touchbase于1992年在倫敦創立，主要發展各項網路?品與資訊通訊等技術。本案系爭侵權產品為「TouchBase商務名片(TouchBase Business Cards)」(如下圖一所示)，TouchBase在名片中植入了油墨電路環路，使用者只需要將此名片置於手機螢幕上，則名片中所記錄的信息就會立刻被轉移到手機上。且存儲在TouchBase名片中的電子信息並不限於列印在名片上的文字信息也可附帶Twitter、Linkedin和Facebook等資料信息，用戶同時也可以在名片中加入視頻信息(註一)。
Touchpac控告TouchBase所製造、販賣的TouchBase Business Cards乃是利用’850專利技術，已直接侵害其專利權。且TouchBase執行長曾於2013年至 T+ink參觀與討論TouchCode技術與產品，因此也已知’850專利存在，故其侵權行為屬於故意侵權，Touchpac請求法院核發永久禁制令，排除TouchBase的侵權行為，並要求TouchBase須支付專利侵害損害、三倍懲罰性賠償金與訴訟相關費用。
