2013年12月20日Parallel Networks Licensing, LLC (以下稱Parallel Networks)，於美國達拉威聯邦地方法院(United States District Court, The District of Delaware)向International Business Machines Corporation (以下稱IBM)提起專利侵權訴訟，指控IBM所販賣的數項軟體與系統侵害Parallel Networks所擁有的US5,894,554(以下簡稱’554專利)、US6,415,335 (以下簡稱’335專利)兩項美國專利。
Parallel Networks是一家專利授權公司，由美國專利商標局之專利轉讓登記資料庫可知，該公司藉由購買取得專利權，目前已登記轉讓取得之專利權僅本案兩項系爭專利。惟該公司所取得之專利權項數雖少，卻已經利用此兩項系爭專利權同時向Microsoft與IBM兩個跨國企業提起專利訴訟。本案系爭專利’554專利名稱為「藉由攔截網路伺服器之請求，以路由至頁面伺服器，並釋放網路伺服器以處理該些請求之動態網頁請求產生管理系統(System for managing dynamic web page generation requests by intercepting request at web server and routing to page server thereby releasing web server to process other requests)」，’335專利名稱為「用於管理動態網頁產生請求之系統與方法(System and method for managing dynamic web page generation requests)」，本案兩項系爭專利皆是與用戶網頁創建與管理相關之技術，兩專利技術之發明人也相同。
Parallel Networks指控IBM的軟體與系統，包括IBM WebSphere Application Server (WAS) (5.0版及其後更新的版本，如EJBs, Workload Management (WLM)、InfoSphere)、Load Balancer、Caching Proxy、On-Demand Router (ODR)、IBM HTTP Server、Network Dispatcher、Metric Server systems and Software、Tivoli systems and software(如Tivoli Access Manager WebSEAL、WebSEAL proxy)、DB2 systems and software(pureScale workload balancing feature)等產品，乃是利用了本案系爭兩項專利技術，IBM未經Parallel Networks授權，即逕自利用其專利技術製造、使用、進口、販賣該些產品，已直接侵害Parallel Networks專利權。
而且，IBM除於2006年時也曾因其客戶涉及本案系爭專利的侵權相關事件，而知悉本案系爭專利之存在外，2012年Parallel Networks也曾通知IBM本案系爭專利相關事宜，因此IBM確實已知本案系爭專利技術，卻仍繼續其侵權行為，顯見IBM之行為實屬惡意侵權。而IBM之產品除用於實現本案系爭專利技術外，並無其他非侵權用途，且其用戶也因使用其產品導致直接侵權，故IBM也成立間接侵權。Parallel Networks請求法院核發禁制令，排除IBM之侵權行為，並要求IBM需支付專利侵害損害賠償訴訟相關費用。(850字；表2)
