波士頓大學控告光寶與晶電侵犯LED高效晶片專利

2012年12月14日，負責監管波士頓大學校務營運之波士頓大學基金會(Trustees of Boston University，下稱波士頓大學)，以本案系爭專利之專利權人身分，向麻薩諸塞州聯邦地院提起兩起專利侵權告訴。

其中一起控告我國第一家製造LED產品的光寶科技(Lite-On Technology Corporation)及其美國分公司Lite-On Inc.、Lite-On Service USA, Inc.與Lite-On Trading USA, Inc.，其所製造銷售的LED產品(如零件編號LOPL-E001MB者)侵犯系爭專利權利。

另一起則控告我國LED供應商龍頭的晶元光電(Epistar Corporation，晶電)以及一家設立於亞利桑那州、銷售包括晶電產品在內之LED照明產品的公司LEDLight.com, LLC，其所輸入與銷售的可調控LED照明產品亦侵犯系爭專利權利。

本案系爭專利為美國專利編號US 5,686,738，名稱為「高絕緣單晶氮化鎵薄膜(Highly insulating monocrystalline gallium nitride thin films)」，於1997年11月11日核發，發明人為波士頓大學電子電腦工程教授Theodore D. Moustakas。

本案系爭專利過往涉及多起專利爭訟。波士頓大學曾將本案系爭專利專屬授權給美國LED製造大廠Cree Inc.(Cree)，並以共同原告身分參與Cree在2001年以系爭專利控告LED產業龍頭日亞化學工業(Nichia Corporation，日亞化)侵權、以及在2003年控告光學半導體廠AXT Inc.侵權的訴訟案件，前者在2002年由Cree與日亞化簽署專利交互授權協議，並就兩者間相關訴訟案件達成和解，後者則在2004達成和解。

2006年，Cree基於系爭專利與另一項專利US 6,657,236，控告另一LED製造商BridgeLux, Inc.侵權，並在2007年其被Honeywell International Inc.(Honeywell)控告專利侵權的訴訟中，基於同樣兩項專利向Honeywell提起反訴，兩案分別在2008年底與2009年以和解收場，而波士頓大學均有參與其中。

2012年10月12日，波士頓大學基於本案系爭專利向本案相同法院提起兩起侵權告訴，分別控告我國億光電子(Everlight Electronics., Ltd.)與韓國首爾半導體(Seoul Semiconductor Company, Ltd)侵犯其專利權利。

晶電為2011年我國LED磊晶片、晶粒廠商之龍頭，而億光與光寶則分居我國LED封裝、模組廠商的第一與第二名。

波士頓大學積極主張專利權給了我們一些啟示。首先，投入經費進行創新研發是重要的；其次，研發成果專利化是必要的，並要有專責專利管理與運用單位；還，需要有好的外界夥伴組織（例如專利服務業者），協助專利運用與積極主張；最後將專利運用後成果回饋到研發流程（流程改善）。(905字；表2)

05-07波士頓大學也控告Amazon使用LED晶片侵權

原告：波士頓大學

2013年5月2日波士頓大學基金會(Trustees of Boston University，下稱波士頓大學)也控告Amazon.com侵犯其US5,686,738 專利權，同時指出Kindle Paperwhite及Kindle Fire顯示器裝置所使用型號B007OZNZG0與B0083Q04IQ之gallium nitride thin film semiconductor device侵權。

10-02波士頓大學LED關鍵738專利再告30家平板廠商

原告： Trustees of Boston University

2013年9月20日波士頓大學基金會(Trustees of Boston University，下稱波士頓大學)往下游平板機終端廠商為目標，控告使用上游LED系爭產品者，共計30家平板及手機公司，包括台灣廠商Acer、Asus、AOC、BenQ、Hannspree、HTC，手機大廠Microsoft、Motorola等。波士頓大學此計畫性發動訴訟，自2012年10月以來已發動近46件訴訟案。目前為止，已有部分LED廠商達成和解，有：Nichia、AXT、Bridgelux、Honeywell等。

2015

11-19台灣LED晶片廠侵權波士頓大學738專利成立

原告： Trustees of Boston University

台灣LED晶片廠與美國波士頓大學基金會（Trustees of Boston University）的專利訴訟案，經美國法院陪審團於2015年11月19日評定侵權成立，晶電、億光、光寶，各須賠償930萬、400萬及36.5萬美元。同時，陪審團也評定惡意侵權成立，但法官尚未就惡意侵權裁定賠償金。

美國波士頓大學基金會與晶電之間的專利訴訟糾紛始於 2012 年，前者向美國麻薩諸塞州聯邦法院提出專利侵權告訴，控告晶電侵犯其美國專利編號 US5,686,738「高絕緣單晶氮化鎵薄膜」（Highly insulating monocrystalline gallium nitride thin films）專利。該案至今纏訟三年，麻州法院陪審團初步裁定賠償金。波士頓大學 US5,686,738 專利已在 2014 年 11 月到期。

波士頓大學基金會多年來以 US5,686,738 專利提起數十件專利侵權告訴，涉及訴訟對象除了晶電外，還包括日亞化學（Nichia）、億光、光寶、宏齊、首爾半導體（Seoul Semiconductor）、三星（Samsung）等 LED 廠，又於 2013 年起控告如宏碁、華碩、明基電通、宏達電、Dell、微軟（Microsoft）、東芝（Toshiba）、索尼（Sony）、LG、蘋果（Apple）、亞馬遜（Amazon）等終端品牌大廠。

波士頓大學則與 LED 晶片廠科銳（CREE）關係良好，將 US5,686,738 專利授權給科銳使用。此外，曾在 2001 年遭波士頓大學控告侵權的日亞化學，後於2015年 11 月與波士頓大學達成和解。

2016

07-22法院同意億光提議重審損害賠償金計算: 原告：波士頓大學

波士頓大學基金會(Trustees of Boston University，波士頓大學)控告億光、晶電、光寶三案【12-cv-11935-PBS、12-cv-12326-PBS、12-cv-12330-PBS】合併審理，歷經4年了。2016年7月22日法院裁決：

一、法院拒絕Everlight 所提出的大多數動議，但其中同意了重新審理(new trial)關於計算損害賠償(damage)的部分；也就是重審晶電(Epistar)及億光(Everlight)之損害賠償，但拒絕重審光寶(Lite-On)。
二、法院拒絕BU提出要求Everlight 支付加重損害賠償(enhanced damage)動議。
三、法院同意BU所提出要求Everlight 支付專家證人費(expert witness fee ) $1,188,220，第三方費用成本$1,084,058 動議；
法院部分同意/部分拒絕BU所提出要求Everlight 支付律師費(attorney fee ) $9,359,276 的動議。

法院同意Everlight需支付BU兩部分律師費：
(1) Everlight 的前任律師曾表示2014 Apr. 所提供銷售資料只包含GaN產品，但開庭前六週，Everlight改主張那些銷售資料也包含 (無侵害的) non-GaN 產品銷售資料；Everlight如此立場改變所衍生的原告律師費。
(2) BU 於2014年10月特派律師來台檢視Everlight 設施中相關的銷售資料出差行程的相關費用。

接下來，法官就是要重審損害賠償金計算，靜待下回報導。
