2015年6月5日，營運總部設在海牙的荷蘭皇家電信公司(Koninklijke KPN N.V.，下稱KPN)，向美國德州東區聯邦地院提起專利侵權告訴，控告南韓手機大廠Samsung Electronics Co., Ltd.以及其美國分公司Samsung Electronics America, Inc.與Samsung Telecommunications America LLP (兩家美國分公司之後者已於2015年1月1日與前者合併後消滅，被告以下統稱Samsung)，其所製造販賣與進口至美國境內、內建有延後計時器(Back-Off Timer)技術功能之通訊裝置產品，包括但不限於Samsung Galaxy S5，直接與間接侵害了KPN所擁有之一件專利權利。
本案系爭專利為美國專利編號US 9,014,667，名稱為「電信網路以及以時間為基礎之網路存取方法 (Telecommunications network and method for time-based network access)」，於2015年4月21日核發，發明人為Johannes Maria van Loon與Michael Robert Schenk。KPN在2013年4月時將系爭專利(當時仍為專利公開案，公開號為US 20110098020)所屬之專利家族，向標準制訂組織歐洲電信標準協會(the European Telecommunications Standards Institute，ETSI)宣告為3GPP TS 23.060 version 10.3.0 Release 10等標準之必要專利(standard essential patent，SEP)，並聲明會依據ETSI之智財權政策來提供授權(IPR Declaration Reference ISLD-201304-005)。
KPN在荷蘭境內營運市話網路以及行動通訊網路，同時亦為網際網路服務供應商(Internet Service Provider，ISP)，並經營數位電視(digital terrestrial television)之服務。KPN亦在其他西歐國家，諸如比利時、德國、法國境內，以透過當地子公司的方式提供行動通訊網路服務。
近年來，KPN曾與Samsung進行專利授權協商，但雙方並無法達成協議。2014年12月30日，KPN向本案相同法院起訴，控告本案相同被告之Samsung Galaxy S4與S5等產品，侵害KPN所擁有之US 5,930,650以及US 6,212,662專利權利(案號為2:14-cv-01165-JRG)，而後在2015年3月30日KPN提出第一修正訴狀(First Amended Complaint)，追加控告Samsung侵害US 8,886,772 專利權利。(982字；表2)
