LTE專利訴訟 Acacia子公司Cellular Communications控告電信業者與手機商

圖、LTE專利訴訟 Acacia子公司Cellular Communications控告電信業者與手機商
 
2015年4月30日，專利授權公司Acacia Research Corporation旗下子公司且營業處所設在美國德州的Cellular Communications Equipment LLC 公司(下稱CCE)，向美國德州東區聯邦地院提起專利侵權告訴，控告在美國提供LTE網路服務之電信公司Verizon(Verizon Communications, Inc.與Cellco Partnership d/b/a Verizon Wireless)、供應在前述Verizon LTE網路中被使用之平板電腦或智慧型手機等產品(稱為使用者設備，user equipment)的手機品牌廠，供應在前述Verizon LTE網路中被使用之基地台設備(稱為網路設備，network equipment)的電信設備供應商等，其製造、販賣或使用前述使用者設備與網路設備之行為，侵害CCE從Nokia處所取得、與LTE通訊技術相關的3件專利權利。
 
本案被控侵權的手機品牌廠包括：Apple (Apple, Inc.)、HTC (HTC Corporation與HTC America, Inc.)、LG (LG Electronics, Inc.與LG Electronics USA, Inc.)與Samsung (Samsung Electronics Co. Ltd.、Samsung Electronics America, Inc.與Samsung Telecommunications America LLC)。本案被控侵權的電信設備供應商則為Alcatel (Alcatel-Lucent S.A.與Alcatel-Lucent USA, Inc.)與Ericsson(Ericsson Inc.與Telefonaktiebolaget LM Ericsson)。
 
而CCE在同日亦向本案相同法院提起另三起專利侵權告訴，分別控告另外三家在美國提供LTE網路服務的電信業者，AT&T (AT&T, Inc.與AT&T Mobility LLC)、Sprint (Sprint Corporation、Sprint Solutions, Inc.、Sprint Spectrum L.P.與Boost Mobile, LLC)、T-Mobile (T-Mobile USA, Inc.與T-Mobile US, Inc.)，為前述個別LTE網路供應使用者設備產品的手機品牌廠(比本案多了ZTE Corporation、ZTE USA Inc.與ZTE Solutions, Inc.)以及供應基地台設備的電信設備供應商(與本案相同)，侵害本案3件系爭專利權利。
 
本案三件系爭專利內容如下：
美國專利編號US 8,457,022，名稱為「用來提供冗餘版本信號之方法與裝置（Method and apparatus for providing signaling of redundancy versions）」，於2013年6月4日核發，原始權利人為Nokia Siemens Networks GmbH & Co. KG；
美國專利編號US8,570,957，名稱為「功率餘量報告擴充及其啟動條件（Extension of power headroom reporting and trigger conditions）」，於2013年10月29日核發，原始權利人為Nokia Siemens Networks Oy；
美國專利編號US 8,867,472，名稱為「通道資訊信號（Signalling of channel information）」，於2014年10月21日核發，原始權利人為Cellular Communications Equipment LLC。
 
Acacia曾在2012年12月31日宣布，其旗下子公司(應為CCE)從Nokia Siemens Networks處取得與2G、3G、4G通訊標準相關的無線通訊架構以及使用者設備技術專利，而後又在2014年12月29日宣布，其旗下子公司再從Nokia Networks處取得額外的通訊技術專利組合，讓其子公司在2G/3G/LTE與LTE-Advanced關聯技術領域已掌握相當規模之專利組合。
 
而CCE每次從Nokia處取得通訊技術相關專利組合後，均會發動一波訴訟攻勢，例如在2013年6月25日，CCE便基於6件從Nokia處所取得之專利權利，向本案相同法院起訴5起專利侵權告訴，分別控告多家手機品牌廠與電信業者侵權(請參見本網站報導《無線通訊專利訴訟Cellular Communications Equipment控告HTC等大廠侵權》)，而其中除涉及BlackBerry一案已和解外(案號為6:13-cv-00510-LED)，其他4起仍在審理中。而本案與CCE在同日起訴其他3起告訴，是從Nokia處取得更多通訊專利組合後所發動的另一波訴訟攻勢。(1187字；表3)

其中前述處理器被配置來，在可適用之情況，決定出兼具功率餘量正值與負值的功率餘量報告，其中負值是指示出執行傳輸要求所會衰減的功率分貝
where RVk is the redundanc version sequence k=i mod 4, i=0,1, . . . , i=0,1, . . . , ns w−1, and ns w denotes a number of subframes within the system information message transmission window.
 RVk是冗餘版本序列k=i mod 4, i=0,1, . . . , i=0,1, . . . , ns w−1, and ns w，表示出在前述系統資訊訊息傳輸窗口中子訊框的數量		 wherein the processor is configured to determine the power headroom by subtracting the nominal maximum transmission power and the power that the apparatus would use if it did not apply maximum power limitations, wherein the result of said subtracting is not limited to zero and positive values.
其中前述處理器被配置來，藉由減去標稱最大傳輸功率以及裝置在未適用最大功率限制時會使用的功率，決定出功率餘量，而前述減去之結果並不限於零與正值
