2015年5月1日，營業處所設於美國馬里蘭州的專利授權公司Speherix Incorporated，向美國維吉尼亞州東區聯邦地院提起專利侵權告訴，以美國目前最大無線通訊服務供應商Verizon旗下8家公司(Verizon Services Corp.、Verizon South Inc.、Verizon Virginia LLC、Verizon Communications Inc.、Verizon Federal Inc.、Verizon Business Network Services Inc.、MCI Communications Services, Inc. 與Cellco Partnership d/b/a Verizon Wireless，以下統稱Verizon)以及網路設備供應商Cisco Systems, Inc. (下稱Cisco)為被告，主張Verzion所提供之各項無線通訊區域網路服務，以及Verizon與Cisco所製造販賣、在前述服務中被使用之路由器或交換器等網路設備產品，侵害Spherix從Rockstar Consortium US LP(下稱Rockstar)處所取得、8件與為資料標示虛擬區域網路識別(VLAN tagging of data frames)之技術相關的專利權利。
8件系爭專利名稱均為「虛擬區域網路資料框格式(VLAN frame format)」，發明人均為Paul James Frantz與Geoffrey O. Thompson。8件系爭專利之間的專利家族關係(參見圖一)為：US 6,111,876專利(2000年8月29日公告，下稱’876專利)為US 5,959,990專利(1999年9月28日公告，下稱’990專利)在申請時的部分連續案(continuation-in-part)；US RE40,999(2009年11月24日公告，下稱’999專利)與US RE44,775(2014年2月25日公告，下稱’775專利)是基於’876專利所申請的分割再核發案(divisional reissues)；US RE45,065(2014年8月5日公告，下稱’065專利)、US RE45,081(2014年8月19日公告，下稱’081專利)、US RE45,095(2014年8月26日公告，下稱’095專利)以及US RE45,121(2014年9月9日公告，下稱’121專利)則為’775專利在申請時的連續再核發案(continuation reissue)。
從圖一中所標示的各系爭專利原始權利人可以看出，系爭專利權利歸屬的變遷軌跡。Bay Networks, Inc.為在1994年由SynOptics Communications Inc.與Wellfleet Communications Inc.兩家合併後所成立的網路硬體設備製造商，其在1998年6月為加拿大電信公司Northern Telecom Limited所併購，而同年Northern Telecom Limited亦更名為Nortel Networks Limited (下稱Nortel)。Nortel在2009年宣告破產，並在2011年將公司所持有的6000多件專利競標拍賣，而由Microsoft、Apple、Ericsson與Sony等公司所組成之Rockstar Bidco, LP聯盟，以45億美元標得前述Nortel專利組合，並移轉給子公司Rockstar Consortium US LP(下稱Rockstar)來進行後續營運。而從2013年7月起，Spherix與Rockstar多次簽訂協議，由Spherix轉讓其部分公司股權給Rockstar，用於交換Rockstar轉讓部分Nortel專利組合中的專利權利。
Spherix在訴狀中將8件系爭專利分為「方法專利」與「裝置專利」兩組，前者包括’990專利、’876專利、’999專利、’775專利、’081專利與’095專利(表一之請求項解析以’990專利為例)，後者則包括’065專利與’121專利(表一之請求項解析以’121專利為例)。就Spherix主張，Verzion所提供之多項無線通訊區域網路服務是直接侵害方法專利權利，而Verizon與Cisco所製造販賣、在前述服務中被使用之路由器或交換器產品，則是輔助侵害方法專利權利，並直接與間接侵害裝置專利權利。

本案並非Spherix首次基於Nortel專利組合中的專利權利起訴控告Verizon與Cisco侵權。在2014年6月11日，Spherix向本案相同法院起訴，控告Verizon所提供之通訊服務與系統，侵害4件Nortel專利組合中的專利權利(案號為1:14-cv-00721-GBL-TCB，請參見本網站報導《通訊服務與系統專利訴訟Spherix控告Verizon》)。該案已於2015年3月16日舉行馬克曼聽證會(Markman Hearing)，並預計在2015年8月10日進行陪審團審理。2014年3月28日，Spherix向德拉瓦州聯邦地院起訴，控告Cisco所製造販賣之路由器或交換器產品，侵害屬於Nortel專利組合之11件專利權利(案號為1:14-cv-00393-SLR)。
在2015年2月3日，RPX Corporation(下稱RPX)宣布子公司RPX Clearinghouse LLC已在2015年1月28日完成向Rockstar收購Nortel專利組合中約4000件專利權利之程序，而伴隨前述程序，RPX亦從Rockstar處取得、Rockstar以Nortel專利組合中專利權利所換得的Spherix公司股權。
據悉，Verizon與Cisco均為RPX之會員，所以本案訴訟似乎會涉及到Spherix與RPX間可能的利益衝突，而RPX未來是否會以股東身分介入本案訴訟進展，值得進一步密切觀察。 (1976字；圖表3)
